RESOLUTION NO. 92-2-18-5
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, INITIATING AMENDMENT TO
TITLE 9 OF THE MUNICIPAL CODE TO ADD PROVISIONS
REGARDING SITING AND DEVELOPMENT OF HAZARDOUS
WASTE FACILITIES
WHEREAS, the County of Orange has adopted the County Hazardous Waste
Management Plan pursuant to Assembly Bill 2948 (Tanner 1986) and certified a program
environmental impact report for that Plan; and,
WHEREAS, the County of Orange has previously prepared and adopted
revisions to the County Hazardous Waste Management Plan pursuant to Assembly Bill
2595 (Tanner 1990) to provide for the "fair share siting" of hazardous waste facilities in
the County; and,
WHEREAS the City has approved the County Hazardous Waste Management
Plan and Environmental Impact Report No. 490 by Resolution No. 89-4-18-1 and
subsequent amendments by Resolution No. 91-5-7-3; and,
WHEREAS, the City is required to comply with the provisions of the Orange
County Hazardous Waste Management Plan and more specifically Assembly Bills 2948
and 2595 (Tanner); and,
WHEREAS, Section 9-2.102(a) of the Municipal Code grants authority to the
City Council to initiate any amendment to Title 9, Land Use Code of the City's Municipal
Code.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby find that:
1. The adoption of "Hazardous Waste Facilities" provisions to Title 9, Land
Use Code, will comply with the legislative provisions of Assembly Bills
2948 and 2595; and,
2. "Hazardous Waste Facilities" provisions will allow the City the
opportunity to effectively manage the various impacts associated with
such uses; and,
3. The City desires to comply with the provisions of State law and the
Orange County Hazardous Waste Management Plan.
BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby direct staff to begin preparation of draft "Hazardous Waste
Facilities" provisions subject to the following:
1. Staff, in preparing the draft provisions shall consider the inclusion of
"hazardous waste facilities" as "conditional uses" subject to specific
locational and site development standards.

2. Staff shall study the appropriateness of the "CM" (commercial
manufacturing) zone district as well as other commercial/industrial zone
districts as candidate districts for such uses.
