APPROVING TENTATIVE PARCEL MAP 92-V3 (TRULIS)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING
TENTATIVE PARCEL MAP 92-123, A FOUR -LOT
PARCELIZATION OF 2.57 ACRES LOCATED WITHIN THE LOS
RIOS HISTORIC DISTRICT, APPROXIMATELY 200 FEET
NORTH OF THE LOS RIOS ENTRY PLAZA, ASSESSOR
PARCEL NOS 121-143-06 AND 121-143-09 (TRULIS)
WHEREAS, the applicant, Thomas Trulis, 32141 Cook Lane, San Juan
Capistrano, California 92675, has submitted an application requesting the approval of a
four -lot parcel map for a 2.57 -acre parcel of land located within the Los Rios Historic
District, 200 feet north of the Los Rios Entry Plaza; and,
WHEREAS, the project site is located within the Historic Residential (HR)
District and the Park (P) District of the Los Rios Specific Plan and designated Special Study
and 2.4 (Specialty Park) by the General Plan; and,
WHEREAS, the Environmental Review board issued a Mitigated Negative
Declaration for the project on August 25, 1992; and,
WHEREAS, at its meeting of August 25, 1992, the Cultural Heritage
Commission reviewed, received and filed this item; and,
WHEREAS, at its meeting of September 23, 1992, the Los Rios Review
Committee, at a duly -noticed Public Hearing, recommended approval of Tentative Parcel
Map 92-123; and,
WHEREAS, at its meeting of October 23, 1992, the Planning Commission
conditionally approved Tentative Parcel Map 92-123; and,
WHEREAS, the City Council hereby finds and determines as follows:
(A) The proposed map as conditioned is consistent with the Land Use
Management Code in that the project complies with all of the
development standards set forth in Specific Plan 78-1, including floor
area ratio for Parcel 1, the parcel upon which the Rodman House is
located.
(B) The design of the proposed map is consistent with the General Plan in
that the division of the site will provide land for a park site, which will

aid in implementing the General Plan Designation of Specialty Park.
The remaining three parcels are intended for residential use which is
also consistent with the General Plan.
(C) The project site is physically suited to the proposed type of
development in that the site is relatively flat and the uses proposed for
the site include park and residential. The establishment of these uses
on the site will require only minimal finish grading of the site at the
time of actual development. Additionally, the organization of the uses
on the site orients the residential portion of the site towards Los Rios
Street and the proposed park site adjacent to both the existing park
site and Trabuco Creek.
(D) The project site is physically suited to the density of the proposed
project in that the proposed parcelization will result in three residential
parcels which will be able to accommodate structures built to the
required floor area ratio and which are consistent in area with existing
parcels in the Los Rios Historic District.
(E) The proposed parcelization will not cause any substantial
environmental damage or injure fish or wildlife in that the conveyance
agreement between Thomas Trulis and the Community Redevelopment
Agency contains provisions for the environmental remediation of the
site which specify that the site is to be brought into compliance with
State standards for health and safety.
(F) The design of the subdivision or its improvements is not likely to cause
any serious public health problems in that the proposed parcelization
is for the conveyance of land and does not proposed any
improvements.
(G) The proposed parcelization will not interfere with any public
easements in that there are no existing public easements contained
within the project boundaries. Additionally the proposal includes a
dedication of right-of-way to facilitate the future extension of Paseo
Adelanto consistent with the Los Rios Precise Plan.
(H) The proposed parcelization will not interfere with the maintenance or
preservation of an historic site in that, although the Los Rios District
is a National Register Historic District, the proposed parcelization
does not propose any improvements that will interfere with the
Rodman House, a contributing structure, nor will there be any earth
moving operations that may disturb archaeological or paleontological
resources on the site. Future development of the site will require

review by the Los Rios Review Committee and the Planning
Commission at which time project specific mitigation measures,
including monitoring of grading operations, amy be required.
NOW, THEREFORE, BE 1T RESOLVED, that the City Council of the City
of San Juan Capistrano does hereby approve Tentative Parcel Map 92-123 subject to the
following condition:
(1) The proposed easement for the extension of Paseo Adelanto shall be
realigned to run parallel to the base of the levee.
(2) The Final Map shall not be approved for filing and recordation prior
to the commencement of the relocation and environmental
remediation of the site.
