Resolution Number 92-7-21-6���F C.0 j �A RESOLUTION NO. 92-7-21-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, RECOMMENDING THAT THE PROPOSED GENERAL PLAN AMENDMENT (GPA 92-01) TO SUBSTITUTE A SENIOR HOUSING USE FOR THE DEDICATED PUBLIC INSTITUTIONAL USE BE MODIFIED TO PROVIDE FOR AN ALTERNATE SITE FOR DEDICATION OF THE PUBLIC INSTITUTIONAL USE, AND DESIGNATION OF THE ORIGINAL PUBLIC INSTITUTIONAL SITE AS A LOCATION FOR AFFORDABLE SENIOR HOUSING (SAN JUAN MEADOWS/SAN JUAN CREEK ASSOCIATES) WHEREAS, the applicant, San Juan Creek Associates, has submitted applications for General Plan Amendment 92-01, a proposed General Plan Amendment to substitute a senior housing use for the dedicated Public Institutional use together with Rezone 91-01, an amendment to the Forster Canyon Planned Community Comprehensive Development Plan to allow 275 attached and single-family residential units, 180 senior housing units and a golf course; Architectural Control 92-02, a Site Development Review Application for a townhouse development; Vesting Tentative Tract Map 14343, all for a proposed 148 -acre planned community project located in the southern portion of the City of San Juan Capistrano; and, WHEREAS, the Environmental Review Board has reviewed the project and has determined that the proposed project may have a significant impact on the environment; has required that an Environmental Impact Report be prepared; and has otherwise carried out all requirements of the California Environmental Quality Act; and, WHEREAS, public hearings have been duly advertised and held by the Planning Commission on May 4, 1992; and June 9, 1992 to review and receive public testimony on the applications and Environmental Impact Report; and, WHEREAS, the Planning Commission of the City of San Juan Capistrano recommended approval of the General Plan Amendment pursuant to Planning Commission Resolution No. 92-6-9-4; and, WHEREAS, the City Council of the City of San Juan Capistrano conducted a duly noticed public hearing on July 21, 1992; and, WHEREAS, the City Council does hereby find and determine as follows: Environmental Impact Report The Draft Environmental Impact Report, which incorporates responses to comments, adequately discloses the environmental -1- impact of the project and identifies appropriate mitigation measures. 2. The Final Draft Environmental Impact Report has been prepared in conformance with the California Environmental Quality Act and has been forwarded to the City Council. 3. All impacts will be mitigated to a level of insignificance in the form of plan changes or conditions of approval. 4. The Environmental Impact Report includeshil correspondence, public testimony, and staff reports. General Plan Amendment 92-01 1. The proposed amendment to the General Plan, is consistent with all the elements of the General Plan. 2. The subsequent development of the property under the proposed General Plan Amendment will conform to the development standards and other applicable provisions of Title 9 of the City Municipal Code (Land Use). NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby take the following actions regarding General Plan Amendment 92-01: 1. Certification of the Environmental Impact Report based upon a finding that the document, including responses to comments, and a record of public hearings, adequately addresses the impacts of the project. 2. That the General Plan not be amended to delete the requirement for a dedicated Public/Institutional site. 3. That the General Plan Amendment be approved with the following changes: a. Add the following to the text of the Land Use Element on page 23 after the fifth paragraph under the heading "Forster Canyon Planned Community". There are a range of uses that would be appropriate for a Public Institutional Site on this project, and the merits of a senior housing project are also recognized. The City will receive dedication of the 8.5 acres, which shall be designated Public/Institutional and is located on the north side of La Novia Avenue. This location shall become the dedicated Public/Institutional site, and the originally -2- designated Public/Institutional site adjacent to the landfill shall be re -designated as a location for senior housing. This dedication shall not be considered as fulfilling any other requirements for dedications, fee credits, etc. that apply to the project. Land use designations for the Mesa have been changed as a part of General Plan Amendment 92-01. These changes are the result of an updated assignment of development potential to these development areas based on the most current information regarding land fill closure requirements and circulation needs. The intent of the 1.4 and 1.5 residential designations is to allocate the maximum unit count of 275 units within the Mesa portion of the Forster Canyon Planned Community, providing for a maximum of 120 units in the 1.5 designated area and a cumulative total of 155 units in the two 1.4 designated areas (94 units in the area adjacent to La Novia and 61 units in the area to the south). b. Add a new land use designation for Senior Housing by amending the text and map as follows: Add the following text to the Land Use Element of the General Plan (page 16, final paragraph under the heading of Residential Land Uses ): A special land use designation, 1.7 Senior Housing, has been added by General Plan Amendment 92-01 for Senior Housing. This designation recognizes the unique nature of this form of affordable housing. Senior Housing allowed under this designation are projects where qualifying elderly live independently, but also have the benefit of common facilities and amenities tailored to the special needs of seniors. Because the occupancy factor of such housing is about one third of conventional housing, dwelling units per acre can be higher than for conventional land use designations or zoning without affecting population growth impacts anticipated in the General Plan. Actual densities and standards for this land use are to be established by controls made a part of a Planned Community Comprehensive Development Plan or the adoption of an amendment to the Land Use Code. Add to the Legend on the Composite General Plan Map the following designation: 1.7 Senior Housing C. Amend the Composite General Plan Map to designate the north side of La Novia within the project as "5.0 Public and Institutional," designate the Senior Housing site on the south side of La Novia as "1.7 Senior Housing" and designate the "Valley" development area -3- of the Forster Canyon Planned Community with "5.2, Future Public School Sites" as shown on Exhibit 1 attached to this resolution.
