' APPROVING TWO-YEAR EXTENSION OF TIME - TENTATIVE PARCEL NFAM435
(RESCO DEVELOPMENT COMPANY/CAPISTRANO GATEWAYI
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING TWO-YEAR
TIME EXTENSION - TENTATIVE PARCEL MAP 89-435 (CAPISTRANO
GATEWAY/RESCO DEVELOPMENT COMPANY)
WHEREAS, the applicant, Resco Development Company, 23052 Alcalde, Suite B, Laguna Hills,
CA 92653, has submitted applications for approval of Tentative Parcel Map 89-435, proposing to subdivide
approximately 15.2 acres of land into 20 lots generally located at the southeast corner of Via Escolar and Rancho
Viejo Road; and,
WHEREAS, the City's Environmental Review board has determined that the overall Capistrano
Gateway/Resco Project, of which this application is a part, will have a significant impact on the environment,
has accordingly required the preparation of an Environmental Impact Report, and has otherwise carried out all
other requirements of the California Environmental Quality Act; and,
WHEREAS, the City's Planning Commission has forwarded the project to the City Council
recommending approval; and,
WHEREAS, the applicant has requested a 24 -month time extension of the approval of Tentative
Parcel Map 89-435; and,
WHEREAS, a public hearing has been duly advertised and held to review and receive public
testimony on the applications; and,
WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as
follows:
1. The proposed project, for the reparcelization from 2 to 20 lots, as conditioned, and its
design and improvements, is consistent with the Public Institutional designation on the
General Plan policies and map.
2. The proposed project, as conditioned, conforms to all applicable requirements of Tide
9 of the City's Municipal Code (Land Use).
3. The project site is physically suitable for the type of proposed development.
4. The design and improvements of the proposed project will not cause substantial
environmental damage; nor will said design or improvements avoidably injure wildlife
or their habitat.
5. The design and improvements of the proposed project will not cause serious public
health problems.
6. The design and improvements of the proposed project will not conflict with easements
acquired by the public at large for access through or use of property within the
proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby approve Tentative Parcel Map 89-435, subject to the following conditions:

Prior to final map approval, the subdivider shall complete the following:
1. Submit for the Planning Director's Review and approval, a draft copy of the project's
Conditions, Covenants and Restrictions (CC&R's) which establish a Transportation
Management Association in accordance with the provisions of Section 9-9.105
(Transportation Management Association [TMA] standards) of the Municipal Code.
2. The applicant shall dedicate the Rancho Viejo Road right-of-way via an irrevocable
offer of dedication so that the ultimate pavement design of Rancho Viejo Road can
be accommodated, plus an irrevocable offer of easement for a bicycle trail and utilities
to the satisfaction of the City Engineer.
3. The applicant shall post the necessary bond to ensure that the ultimate pavement and
bicycle trail improvements for Rancho Viejo Road will be consistent with the ultimate
design of improvements along Rancho Viejo Road as determined by the Concept Plan,
which will be designed by the Transportation Corridor Agency in conjunction with the
confluence design for the San Joaquin Hills Transportation Corridor and to the
satisfaction of the City Engineer.
4. The following improvement shall be designed to the satisfaction of the City Engineer
prior to final parcel map approval:
a. The southernmost driveway shall be designed for right turn in and out only.
b. The easement for the proposed bicycle path along the existing Rancho Viejo
Road frontage shall be provided on the final parcel map, and shall conform
to the design standards set forth in the Municipal Code.
C. A detail of the northbound bus turnout design shall be included on the final
site plan and shall be approved by the Orange County Transportation
Authority.
d. The applicant shall investigate the feasibility of an appropriate location for a
southbound bus turnout on Rancho Viejo Road and shall incorporate a detail
for the southbound turnout on the final site plan.
S. The applicant shall participate in the following improvements based on a pro -rata
share of traffic generated, in accordance with the traffic study in the Environmental
Impact Report Addendum and approved by the City Engineer.
a. A traffic signal at Via Escolar and Rancho Viejo Road.
b. A traffic signal at Rancho Viejo Road and Village Road.
C. The Rancho Viejo Road bridge over Trabuco Creek.
d. The traffic signal at the intersection of Village Road and Rancho Viejo Road
shall be installed and operational prior to issi anf P of occupancy permits for
the project.
6. An open space easement shall be dedicated to the City for Lot 20. Adjustments to the
document shall recognize the transfer of land from Lot 20 to Coast Bible Church for
that portion of the lot containing the existing barn and adjacent area to create minimal

setbacks in accordance with the Public/Institutional District. Said transfer to take
place prior to or concurrent with recordation of final map.
7. Grading easement from adjacent property for parking prior to final parcel map
approval.
BE IT FURTHER RESOLVED, that per Section 9-2.305 of the Municipal Code, this tentative
map approval shall expire on April 16, 1995; i.e., two (2) years from the original City Council approval date, and
the development approval shall be come null and void.
