Resolution Number 93-6-1-4RESOLUTION NO. 93-6-1-4 ' DENYING APPEAL OF PLANNING COMMISSION ACTION - EXCEPTIONS TO PERMIT FOR OFF-SITE SIGNS, ARCHITECTURAL CONTROL 87-1 (THE PRICE COMPANY/WE,SELOH CAR DEALERSHIP) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DENYING AN APPEAL OF THE PLANNING COMMISSION ACTION OF APRIL 27, 1993, DENYING SIX EXCEPTIONS TO SECTION 9-3.603 (SIGNS) OF THE MUNICIPAL CODE FOR THE PROJECT LOCATED ON THE CREST OF THE HILL AT THE SOUTHWEST CORNER OF STONEHILL DRIVE AND CAMINO CAPISTRANO (THE PRICE COMPANY/WESELOH CAR DEALERSHIP) WHEREAS, the applicant, The Price Company, P. O. Box 85466, San Diego, California 92186-5466, has requested approval of six exceptions to Section 9-3.603 (Signs) of the Municipal Code which would permit the following: 1. An off-site sign, which is prohibited, to be located on the hill at the southwest corner of Stonehill Drive and Camino Capistrano; 2. An eight -foot, six -inch -tall sign where six feet is permitted; 3. Sign copy area of 108 square feet where 60 square feet is permitted; 4. Internal illumination where external illumination is permitted; ' 5. A time and temperature unit with mechanical movement, which is prohibited; 6. A 50 -foot flag pole, which is not permitted when used as an attention -getting device for advertising; and, WHEREAS, this project has been processed and reviewed in accordance with the California Environmental Quality Act (1970) and has been determined to be categorically exempt (Class 3) from further environmental review-, Class 3 exemptions include new construction or conversion of small structures; and, WHEREAS, on April 27, 1993, the Planning Commission held a duly -noticed public hearing to receive public comment on Architectural Control 87-1 (modification) to consider six exceptions to Section 9- 3.603 (Signs) of the Municipal Code, and adopted Resolution No. PC 93-4-27-1, denying said exceptions; and, WHEREAS, the applicant has submitted an appeal of the Planning Commission's denial of said exceptions; and, WHEREAS, on June 1, 1993, the City Council held a duly -noticed public hearing to receive public comment on the appeal of the Planning Commission's action of April 27, 1993. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, after reviewing all written material submitted on the appeal and considering all material presented during the public hearing, does hereby find and determine as follows: 1. The proposed sign does not comply with six of the design standards of Section 9-3.603 (Signs) of the Municipal Code, in that it is an off-site sign which would incorporate 1- 346 internal illumination, mechanical movement, and a flag pole which would serve as an attraction -getting device, all of which are prohibited. The sign also exceeds the maximum height and copy area permitted. 2. The proposed sign would be harmful to surrounding properties in that the sign deviates from six of the design criteria, thus creating a visual blight. The blight would be exacerbated by its prominent location, which has high visibility from two major streets, the freeway and many surrounding properties. The resulting sign would result in the type of visual blight that the sign regulations were intended to prevent. 3. The applicant has not provided justification for the need to have granted multiple exceptions, in that except for the off-site location, all other similar types of land use must comply with the City's Design Standards. BE IT FURTHER RESOLVED, that based upon the above findings, the City Council hereby affirms the action of the Planning Commission and denies the applicant's appeal.
