RESOLUTION NO. 93-5-4-4
URGING SPONSORSHIP OF CALIFORNIA CONSTITUTIONAL AMENDMENT -
PRESERVATION OF FUNDING TO CITIES (CALIFORNIA LEAGUE OF CITIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO, CALIFORNIA, URGING THE
CALIFORNIA LEAGUE OF CITIES TO SPONSOR AN
INITIATIVE FOR A CALIFORNIA CONSTITUTIONAL
AMENDMENT TO PRESERVE THE FUNDING OF CITIES
WHEREAS, the State of California authorized counties to assess cities for the
expense of booking prisoners, causing cities to have problems funding vital services; and,
WHEREAS, the State of California authorized counties to assess cities for the
expense of collecting and disbursing property taxes, causing additional problems to fund vital
services; and,
WHEREAS, during the present fiscal year, the State of California has taken
' various sources of revenue from cities to be utilized for other purposes, causing cities to
reduce fire, paramedic and police protection and further reduce other vital services; and,
WHEREAS, the State of California appears not to be making a serious effort
to reduce its expenditures.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City
of San Juan Capistrano petitions the California League of Cities to expend its efforts toward
an initiative for a California Constitutional Amendment which will reserve for cities the
same percentage of each source of revenue that was going to the average city in 1988.
Excepted from this requirement would be taxes approved by the voters for special purposes.
BE IT FURTHER RESOLVED, that the Constitutional Amendment would
require that any expenditures required of cities by the State of California or any agency or
authority thereof, after 1988, shall hereafter be fully funded by the State of California.
BE IT FURTHER RESOLVED, that the amendment would require that any
and all fees and/or charges, authorized by the State of California, for cities to pay to
counties or any agency or authority of the State of California that were not so charged prior
to 1988 shall hereafter be fully -funded by the State of California.

BE IT FURTHER RESOLVED, that the Constitutional Amendment would
contain a requirement that if any part of the Amendment was for any reason ruled invalid,
the remaining parts shall remain in full force and effect.
