Resolution Number 93-4-6-627'9 RESOLUTION NO. 93-4-6-6 I INITIATING AMENDMENT TO TITLE 9 OF THE I CENTRAL RECYCLING FACILI A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, INITIATING THE PREPARATION OF AN AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE TO ADD PROVISIONS FOR CENTRAL RECYCLING FACILITIES IN COMPLIANCE WITH STATE ASSEMBLY BILL 1327 WHEREAS, the State legislature has adopted Assembly Bill 1327, the Solid Waste Reuse and Recycling Access Act, which requires that all cities and counties incorporate regulatory provisions in their Codes with respect to central recycling areas; and, WHEREAS, Assembly Bill 1327 requires that cities and counties adopt regulatory provisions with respect to central recycling areas prior to September 1, 1993; and, WHEREAS, Assembly Bill 939, the Source Reduction and Recycling Act and Assembly Bill 2020, Bottle Recycling Bill, require cities and counties to reduce their solid waste output by twenty-five percent (25%) before January 1, 1995, and by fifty percent (50%) before January 1, 2000, and central recycling areas will facilitate recycling efforts in the City which serve to meet these legislative mandates; and, ' WHEREAS, the City has adopted a recycling facilities ordinance and instituted a curb -side recycling program within the City and regulatory provisions for central recycling areas will complement existing solid waste management efforts of the City; and, WHEREAS, the Government Code grants the City specific enabling authority to regulate local land uses including "central recycling areas"; and, WHEREAS, Section 9-2.102(a) of the Municipal Code grants sole authority to the City council to initiate any amendment to Title 9, Land Use Code of the City's Municipal Code. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find that; 1. Adoption of a central recycling area ordinance is necessary to comply with State law and would further compliance with State -mandated solid waste reduction quotas and target dates; and, 2. Adoption of a central recycling area ordinance would complement the City's existing regulatory and programmatic efforts involving solid waste management. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby direct staff to prepare a draft "central recycling area" ordinance.
