Resolution Number 93-4-6-4a 5� RESOLUTION NO. 93-4-6-4 ' CERTIFYING FINALSUBSEQUENT ENVIRONMENTAL IMPACT REPORT 91-3 CONCORDE DEVELOPMENT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CERTIFYING THE FINAL SUBSEQUENT ENVIRONMENTAL IMPACT REPORT 91-3 FOR THE CONCORDE DEVELOPMENT PROJECT CONSISTING OF GENERAL PLAN AMENDMENT 91-3, ZONE CHANGE 91-2, TENTATIVE TRACT MAP 14398, GROWTH MANAGEMENT REVIEW 91-1, AND HILLSIDE MANAGEMENT 91-2 AND RIDGELWE EXCEPTION REVIEW 93-L AS ADEQUATE AND COMPLETE AND ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS AND MITIGATION MONITORING PLAN (CONCORDE DEVELOPMENT) WHEREAS, the applicant, Concorde Development 19752 MacArthur Boulevard, Suite 240, Irvine, California 92714, has submitted an application for a proposed General Pian Amendment, GPA 91-3, to relocate 1,200 feet of Major Ridgeline; a Zone Change, RZ 91-2, from Growth Management (GM) to Single Family District (RS) to allow 10,000 -square -foot residential lots; a Tentative Tract Map, TTM 14398 proposing a subdivision of 99 acres to allow 87 residential lots; Hillside Management Review, HM 91-3, a review of grading and landform alteration, Growth Management Review, GM 91-1; and, WHEREAS, on March 5, 1991, the City Council certified Final Environmental Impact Report 90-2 for a project at this site; and, ' WHEREAS, on November 5, 1991, the City Council denied a project at this site due to grading impacts; and, WHEREAS, the applicant revised the project and the City's Environmental Review Board determined that the proposed project may have a significant effect on the environment pursuant to Section 15163 of the California Environmental Quality Act Guidelines and required the preparation of a Subsequent Environmental Impact Report and accordingly retained a consultant to prepare a Subsequent Environmental Impact Report to address such significant effects in accordance with the California Environmental Quality Act, the State California Environmental Quality Act Guidelines, and the City's Environmental Review Guidelines; and, 1 WHEREAS, in accordance with Section 15083 of the California Environmental Quality Act Guidelines, numerous opportunities were provided for public participation in the environmental review process, both before and during preparation of the Subsequent Environmental Impact Report. These included the following: 1. On July 22, 1992, a public scoping meeting, an optional step under the California Environmental Quality Act, was held in the City of San Juan Capistrano to identify issues to be addressed by the Subsequent Environmental Impact Report. 2. On July 27, 1992, a second public scoping meeting was held in the City of San Clemente to identify issues to be addressed by the Subsequent Environmental Impact Report. This meeting was attended by over 100 residents, many of whom submitted written comments. Be Z 56 3. Direct meetings and phone contacts between City staff and concerned residents of the City of San Juan Capistrano, residents of San Clemente, and the City of San Clemente staff. 4. The inclusion of residents and interested persons beyond the required 300 -foot boundary radius for mailing of the Planning Commission and City Council public hearing notices regarding the Subsequent Environmental Impact Report and the project; and, WHEREAS, the Final Subsequent Environmental Impact Report, consisting of the draft Subsequent Environmental Impact Report, comments from the public on the draft report, and responses to those comments in accordance with Section 15088 of the California Environmental Quality Act Guidelines, has been reviewed by the Planning Commission and City Council. Said Final Subsequent Environmental Impact Report is incorporated by reference and on file in the Office of the City Clerk, as fully set forth herein, as Exhibit "A"; and, WHEREAS, a Planning Commission public hearing was published in the Capistrano Valley News and held on December 8, 1992, and continued to January 12, 1993, and February 9, 1993, to receive and review public testimony on the Draft Subsequent Environmental Impact Report and the project; and, WHEREAS, at the direction of the Planning Commission, an alternative project design was prepared by staff which would reduce soil import from the Ridgeline and Knoll Preservation Alternative; and therefore, in accordance with the California Environmental Quality Act Guidelines, Section 15164, an Addendum to the Subsequent Environmental Impact Report has been prepared. Said Addendum is incorporated by reference and on file in the Office of the City Clerk, as fully set forth herein as Exhibit "B"; and, WHEREAS, the Planning Commission granted the applicant's request for a continuance on January 12, 1993, in order for staff and applicant to explore additional alternatives and a Revised Staff Alternative was prepared. Therefore, in accordance with the California Environmental Quality Act Guidelines, Section 15164, an Addendum to the Subsequent Environmental Impact Report has been prepared. Said Addendum is incorporated by reference and on file in the Office of the City Clerk, as fully set forth herein, as Exhibit "C'; and, WHEREAS, on March 2, 1993, the City Council considered the staff and Planning Commission recommendation along with another plan alternative submitted by the applicant on February 24, 1993, and referred that plan alternative back to the Commission for review and report according to Municipal Code Section 9-2.305(8); and, WHEREAS, in accordance with California Environmental Quality Act Guidelines, Section 15164, an addendum to the Subsequent Environmental Impact Report has been prepared to describe the applicant's February 24, 1993, plan alternative, and said addendum is incorporated by reference and on file in the Office of the City Clerk, as fully set forth herein as Exhibit "D"; and, WHEREAS, with respect to the applicant's February 24, 1993, plan alternative, the City Council finds that pursuant to Section 15091 of the California Environmental Quality Act Guidelines, that changes or alternations have been identified in the form of project redesign and mitigation measures which avoid or reduce to a level of insignificance most of the significant environmental effects identified in the Final Subsequent Environmental Impact Report. The project redesign and mitigation measures being fully described in the addendum, Exhibit "D"; and, -2- 257 WHEREAS, with respect to the applicant's February 24, 1993, plan alternative, ' because impacts to biological, wildlife, and visual resources cannot be avoided or reduced to a level below significance, a Statement of Overriding Considerations which cites specific economic, social and other consequences that make infeasible other project alternatives identified in the Environmental Impact Report is incorporated by reference, and on file in the Office of the City Clerk, as fully set forth herein, as Exhibit "E"; and, WHEREAS, the City Council held a duly -noticed public hearing on March 2, 1993, which was continued to April 6, 1993; and, WHEREAS, the City, through its environmental consultant, has prepared a monitoring program to ensure that mitigation measures identified in the Subsequent Environmental Impact Report are implemented, which is incorporated by reference and on file in the Office of the City Clerk as fully set forth herein, as Exhibit "F". NOW THEREFORE BE IT RESOLVED, that in accordance with Section 15090 of the California Environmental Quality Act Guidelines, the City Council of the City of San Juan Capistrano does certify that: 1. Subsequent Environmental Impact Report 91-3 was prepared in compliance with the California Environmental Quality Act and is final and complete. 2. The information continued in the Final Subsequent Environmental Impact Report was reviewed and considered by the City Council prior to action on the project. BE IT FURTHER RESOLVED, that in accordance with Section 15093 of the California Environmental Quality Act Guidelines and Section 21081.6 of the Public ' Resources Code, the City Council of the City of San Juan Capistrano does adopt: 1. A Statement of Overriding Considerations identified as Exhibit "E" to this resolution. 2. A Mitigation Monitoring Program identified as Exhibit "F" to this resolution.
