Resolution Number 93-3-2-12 1 T I RESOLUTION NO. 93-3-2-1 DENYING GENERAL PLAN AMENDMENT 91-3 (CONCORDE DEVELOPMENT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DENYING GENERAL PLAN AMENDMENT 91-3, A PROPOSAL TO RELOCATE APPROXIMATELY 1,200 FEET OF A GENERAL PLAN MA30R RIDGELINE WITHIN A PARCEL LOCATED AT THE NORTHERLY TERMINUS OF CAMINO LAS RAMBLAS (CONCORDE DEVELOPMENT) WHEREAS, the applicant, Concorde Development, 19752 MacArthur Boulevard, Suite 240, Irvine, California 92714, has submitted General Plan Amendment 91-3, proposing to relocate approximately 1,200 feet of the General Plan Major Ridgeline within a 99 -acre parcel located at the northerly terminus of Camino Las Ramblas and described as Assessor's Parcel Numbers 124-081-34, 675-311-01, and 675-321-01; and, WHEREAS, on November 5, 1991, with the applicant as petitioner, the City Council initiated a General Plan Study for the subject property and directed staff to conduct a General Plan Study to consider adjusting a designated General Plan Ridgeline; and, WHEREAS, the applicant was advised at the referenced meeting that initiation ' of the General Plan Study did not indicate any intention to approve a General Plan Amendment, but would allow staff, the Planning Commission, and City Council to study the merits of the proposal; and, WHEREAS, the City's Environmental Review Board determined that the proposed project may have a significant effect on the environment and has accordingly required preparation of a Subsequent Environmental Impact Report and has otherwise carried out all requirements of the California Environmental Quality Act; and, WHEREAS, the Planning Commission held a duly -noticed public hearing on December 8, 1992, which was continued to January 12, 1993, and February 9, 1993, at which public testimony was received and considered; and, WHEREAS, the City Council held a duly -noticed public hearing on March 2, 1993 at which public testimony was received and considered. NOW, 'THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby deny General Plan Amendment 91-3 to relocate approximately 1,200 feet of General Plan Major Ridgeline within a 99 -acre parcel based upon the following findings: a. The proposed project is not consistent with the General Plan of the City because it would cause extensive grading of a General Plan Major Ridgeline and actual lowering of the elevation of that ridgeline of up to 110 feet along a 1,200 -lineal -foot segment. The resulting ridgeline ' profile would thus be reduced by more than 70% from the elevation of its most visible City viewing area, Camino Las Ramblas. The proposed -I- project essentially would remove over one million cubic yards of mountainside to fill a canyon. The proposed General Plan Amendment would be in conflict with the following sections of the Community Design Element of the General Plan (pp. 151-156): (1) Policy - Promote conservation of the natural environment, including ridgeline preservation. (2) Criteria - Sensitive treatment of the natural topography including ridgelines. (3) Criteria - Preservation of natural topographic features. b. The proposed project is not consistent with the objectives of the City's Hillside Development Regulations cited in the Open Space and Conservation Element of the General Plan as the measure of ridgeline preservation (p.46) because it does not attain the objective of design and arrangement of building sites and reduced residential densities on steeper terrain so as to limit the extent of grading alterations. In direct contradiction of that objective, the proposed project would mine most of the soil from the visible natural steep terrain in order to expand the building site. BE IT FURTHER RESOLVED, that based on the findings set forth above, the City Council determines that the proposed General Plan Amendment 91-3 is in conflict with objectives of the General Plan and is denied.
