RESOLUTION NO. 93-2-2-3
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, APPROVING APPEAL OF
PLANNING COMMISSION ACTION AND APPROVING
CONDITIONAL USE PERMIT 92-2 FOR OUTDOOR NIGHT
LIGHTING OF AN EXISTING ATHLETIC FIELD LOCATED AT THE
RANCHO CAPISTRANO COMMUNITY CHURCH SITE, 29251
CAMINO CAPISTRANO (MEEK)
WHEREAS, the applicant, Patrick Meek, 34118 Pacific Coast Highway, Dana
Point, has requested approval of a Conditional Use Permit to allow the installation of
outdoor night lighting consisting of nine 35 -foot -tall poles, each fitted with two 1,000
watt metal halide lamps, for an existing athletic field. The project site is located within
the Open Space (OR) District at the Rancho Capistrano Community Church, 29251
Camino Capistrano; and,
WHEREAS, this project has been processed and reviewed in accordance with
the California Environmental Quality Act (1970) and the City's Environmental Review
Board reviewed this project and determined that it qualified for issuance of a mitigated
negative declaration; and,
' WHEREAS, on December 8, 1992, the Planning Commission held a duly -noticed
public hearing to receive public comment on Conditional Use Permit 92-2; and,
WHEREAS, at its meeting of December 8, 1992, the Planning Commission
conditionally approved the proposed lighting; and,
WHEREAS, the applicant submitted an appeal of a condition of the approval
on December 21, 1992.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby find and determine as follows:
A. The proposed lighting will be compatible with those land uses directly
adjacent to the site in that the lighting will be limited to the subject
property and that adjacent uses, which consist of open space, the I-5
Freeway and Oso Creek, are not of the type that would generally be
adversely affected by outdoor recreational activities.
There are residential uses approximately 2,000 feet to the west which
will be protected from adverse impacts by the inclusion of conditions
regarding announcer amplification at athletic events and limited hours
for the use of lighting.
B. The proposed lighting is consistent with Section 9-3.614 (Lighting) of the
Municipal Code in that direct rays from the proposed lighting will be
' substantially confined to the subject property.

BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano hereby approves Conditional Use Permit 92-2, permitting the installation of
lighting subject to the following conditions:
1. No outdoor loudspeakers shall be permitted for athletic events held at
this site.
2. Lights shall not be used between 10:00 p.m., and sunrise.
