A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING
DEVELOPMENT FEES AND DEPOSITS FOR THE PROCESSING -`F
PLANNING DEVELOPMENT APPLICATIONS AND REPEAL. NG
RESOLUTION NO. 90-11-6-1
WHEREAS, the City Council has adopted Resolution No. 90-11-6-1, which
establishes fees and deposits for processing of planning development plans, divisions of
land, administrative matters, and other related land issues; and,
WHEREAS, the City's overhead rate has increased since July, 1992, resulting in
the need to collect additional funds to complete planning processing; and,
WHEREAS, the City has developed revised cost figures associated with
processing planning development applications.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San
Juan Capistrano as follows:
SECTION 1. Establishment of processing Fees and Deposits
The processing fees and deposits set forth in Exhibit A, attached and
incorporated by reference, are hereby adopted with respect to processing of development
applications within the Planning Services Department.
SECTION 2. Repealer
All planning development application fees and deposits previously established
by Resolution No. 90-11-6-1 are hereby repealed.

' The fees and/or deposits listed below are required to be paid prior
to any processing of a development application. The initial
deposits are intended to provide funding for processing of an
application. If the deposited funds are depleted during the
processing of the application, additional funds will be required
by the City. If the requested funds are not received, processing
of the development application may be delayed or interrupted
pending receipt of the funds. Any unused funds at project
completion will be reimbursed to the applicant.

50 percent the amount shown if processed concurrently with an
application requiring a deposit not asterisked.
** Deposits of $10,000 or above may be made in installments as
determined by the Director of Administrative Services.
*** Fee to be charged by the hour. Fractions of hours to be
charged at $25.
**** Fees are for residential land use adjustments and zone
variances only. Adjustments and variances processed
concurrently with other development applications will be
charged in accordance with the associated developer deposit.
NOTE: The Planning Director may adjust the initial deposit for
a given project upon determination that the initial
deposit will be substantially above or below the amount
estimated to complete the project.

2. Hourly rates of City staff shall be determined from the
current salary schedule adopted by City Council resolution
each fiscal year.
3. Overhead costs shall be added to the staff's hourly rate.
Overhead shall be calculated and published biannually (January
15 and July 15) by the Director of Administrative Services in
accordance with the Office of Management and Budget Circular
A-87 (Cost Principles for State and Local Governments).
Consultant Rates
1. Consultants' actual costs shall be charged against the
developer deposit account. The consultant contracts are
determined by the Planning Director and/or Planning Manager.
A 10 percent administrative fee is charged against the
applicable developer deposit account for any consultant
invoices processed on that project.
