Resolution Number 94-1-4-1241 RESOLUTION NO. 94-1-4-1 APPROVINGDEMOLMON PERNOrr• ;a•__a•• REOTUTT FOR HANKM COTTAGE LDC&M AT 2= 011t� HIGHWAY • RESCINDING RESOLUTIONNO. 93-9-7-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING A REQUEST FOR DEMOLITION OR RELOCATION OF THE HANKEY/ROWSE COTTAGE LOCATED AT 28232 ORTEGA HIGHWAY, AT THE OPTION OF THE PROPERTY OWNER, AND RESCINDING RESOLUTION NO. 93-9-7-10 WHEREAS, the applicants, Lorna Ross and John Hankey, 9152 Loma Street, Villa Park, California 92667, have submitted an application requesting approval for a Demolition Permit or relocation of the Hankey Cottage located at 28232 Ortega Highway as part of an application for Tentative Parcel Map 92-107 to subdivide an approximately one -acre parcel into four separate parcels; and, WHEREAS, the "Hankey/Rowse Cottage" is listed on the City's Inventory of Cultural and Historic Landmarks based on its architectural and historical importance to the community and has been determined to be potentially eligible for inclusion on the National Register of Historic Places; and, WHEREAS, this project has been reviewed in accordance with the California Environmental Quality Act (CEQA) and has been determined by the City's Environmental Review Board to require the preparation of an Environmental Impact Report to determine whether there will be a significant impact to the environment if the cottage is demolished. It was determined that the demolition of the cottage would result in potentially significant impacts, and mitigation measures to reduce those impacts were identified. On July 6, 1993, the Cultural Heritage Commission certified the Environmental Impact Report; and, WHEREAS, the Cultural Heritage Commission, at their July 6, 1993, meeting, denied the application for a demolition permit (Cultural Heritage Commission Resolution 93-7-6-1) for the Hankey Cottage due to its historic and architectural significance and recommended three alternatives to its demolition; and, WHEREAS, the applicant subsequently appealed the Cultural Heritage Commission's denial of the demolition permit to the City Council. On August 17, 1993, the City Council reviewed the proposed project, held a duly -noticed public hearing, and continued the public hearing to September 7, 1993; and, WHEREAS, the City Council adopted Resolution No. 93-9-7-10 on September 7, 1993, conditionally approving the demolition permit; and, WHEREAS, subsequent to the City Council's adoption and signing of Resolution No. 93.9-7.10, the applicant requested a change to the language to reflect that the demolition permit is at the option of the property owner. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find and determine that: 1. The adoption of this resolution rescinds the previously -adopted City Council Resolution No. 93-9-7-10. 2. Compelling the applicants to preserve the house could cause a financial hardship for them. -1- 242 BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby conditionally approve a request for demolition or relocation, at the option of the property owner, of the Hankey/Rowse Cottage located at 28232 Ortega Highway, with the following mitigation measure/condition: 1. Prior to the issuance of a demolition permit, or the relocation of the house, the applicant shall submit to the Planning Director for his review and approval, a Historic American Building Survey (HABS) of the house and a biography of the Hankey family for the City's archives.
