GRANTING WAIVER OF TENTATIVE PARCEL MAP PROCESSING -
TENTATIVE PARCEL MAP 93173 WARWICK NISSAN)
' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, GRANTING A WAIVER OF TENTATIVE
PARCEL MAP PROCESSING FOR TENTATIVE PARCEL MAP 93173 TO
CREATE TWO LOTS LOCATED AT 33375 CAMINO CAPISTRANO (BARWICK
NISSAN)
WIIEREAS, Section 9-2.305(q) of the Municipal Code gives the City Council authority to grant
tentative parcel map waivers if it finds that specific criteria have been or would be met by the project; and,
WHEREAS, the proposed tentative parcel map waiver is categorically exempt (Class 15, Minor
Division of Land) from the provisions of the California Environmental Quality Act (CEQA), 1970; and,
WHEREAS, the City Council conducted a duly -noticed public meeting and considered this
project at their meeting of Tuesday, August 17, 1993.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby find that
1. The proposed tentative parcel map is subject to development review as part of the site
plan review and architectural control process for non-residential development. Any
physical development of the property would be subject to additional discretionary
review by the City.
2. The proposed tentative parcel map complies with all the requirements of the
' Subdivision Map Act and Title 9 of the Municipal Code regarding, but not limited to,
area, improvement and design, floodwater drainage control, appropriate improved
public roads, sanitary disposal facilities, water supply availability, environmental
protection, and park land dedication requirements.
BE IT FURTHER RESOLVED, that the City Council does hereby approve a waiver of the
tentative parcel map processing for Tentative Parcel Map 93-173 (Barwick Nissan) subject to the following
condition:
1. Parcel 1 and 2 shall ultimately be limited to a single commercial entrance each onto
Camino Capistrano. The property owner shall record, as part of the final map, a "Joint
Access Easement" between Lots 1 and 2 to allow shared site access. In conjunction
with the site development of Parcel 2, the property owner of that lot shall close the
Parcel 1 northerly entrance by relocating that entrance to the Parcel 2 frontage. The
owner of Parcel 2 shall consult with the owner of Parcel 1 regarding the design of
internal circulation between the two parcels.
