A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, APPROVING AN APPEAL OF
THE SEPTEMBER 13, 1994, PLANNING COMMISSION ACTION TO
APPROVE PROPOSAL OF HENRY KUMAGAI TO CONVERT AN
EXISTING BANK BUILDING AT 32201 CAMINO CAPISTRANO INTO
A GOODYEAR TIRE CENTER
WHEREAS, the applicant, Henry Kumagai, 19021 Canyon Drive, Villa Park,
California, 92667, has requested approval of architectural, site, landscape and sign plans for the
conversion of an existing bank building into a Goodyear Tire Center. The project is located at 32201
Camino Capistrano, within the General Commercial District, and is designated 3.1 on the General
Plan Map; and,
WHEREAS, this project has been processed and reviewed in accordance with the
California Environmental Quality Act (1970). At its meeting of June 28, 1994, the Environmental
Review Board issued a mitigated negative declaration. All mitigation measures have been included
as conditions of approval; and,
' WHEREAS, at its meeting of September 13, 1994, the Planning Commission held
a public meeting to consider testimony both in favor of, and opposed to, the applicant's request. The
Commission conditionally approved the proposal and permitted a vehicle service entrance door on
the east building elevation, facing Camino Capistrano; and,
WHEREAS, the City has received an appeal of that portion of the Planning
Commission's action of September 13, 1994, which permits a vehicle service entrance door on the
east building elevation, filed by the following parties:

WHEREAS, at its meeting of November 1, 1994, the City Council held a public
meeting and considered testimony related to the appeal.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
' Juan Capistrano does hereby make the following findings:

The project plans are in general conformance with the Municipal Code in that
the building meets all of the setback and height requirements of the General
Commercial district. Additionally, the Municipal Code requires one parking
stall per 500 square feet of building area. The building, including proposed
additions, would measure 6,046 square feet, requiring 12 parking stalls. The
applicant has proposed 22 stalls, exceeding the Code requirements.
2. As conditioned the proposed plans are consistent with the General Plan in that
the plans will be revised to delete the proposed service bay door facing
Camino Capistrano, consistent with the General Plan Policies Document
which states that "service stations should be designed so that service doors,
tire racks, etc., be located at the rear of the station and not facing the street."
The Policies Document finther states that "Commercial facilities such as gas
stations should be situated and landscaped in such a manner that loading,
repair or service operations are not visually detrimental to the surrounding
area."
The proposed site plan is compatible with surrounding land uses in that as
conditioned, the applicant will be required to provide a nine -foot -tall wall to
screen the nine -foot door located on the south side of the building, minimizing
visual impacts to adjacent properties. As conditioned, the east vehicle
entrance would be eliminated, preventing negative visual impacts from
Camino Capistrano, and the project would therefore, also be compatible with
the street.
As conditioned the proposed site design provides a desirable environment for
the public in that vehicle entrances to the building would be situated in such
a way that impacts to adjacent properties and Camino Capistrano would be
minimized. Additionally, the proposed circulation within the parking lot
provides for easy access to all proposed parking stalls and handicap access to
the main entrance to the building.
The proposed modifications to the building are consistent with the adopted
Architectural Design Guidelines in that the applicant has proposed to use
high-quality materials including wood and smooth troweled stucco, which are
complimentary to the materials and finishes of the existing building. Also, the
basic massing of the addition is consistent with that of the existing building in
terms of roof pitch and wall height, providing an appearance which is
compatible with the existing portion of the building as well as the remainder
of the Mission Village Center.
The proposed landscape plan will provide a pleasing environment for the
public in that the applicant has proposed a palette which utilizes elements of
the existing landscaping, including India Hawthorn and Compact Xylosmsa,

and complementary plantings including European Sycamore Trees and New
Zealand Christmas Trees.
Additionally, the placement of the landscaping will provide screening of the
vehicle entrance on the southwest comer of the building and soften the
appearance of the building addition as viewed from Camino Capistrano. The
nine -foot wall which is necessary to completely screen the nine -foot auto
court door(s) will be softened by plantings of creeping fig.
BE IT FURTHER RESOLVED, that the City Council does hereby approve the
appellants request to delete the vehicle service entrance door proposed for the east elevation of the
proposed Goodyear Tire Center and, does hereby affirm the remaining conditions placed by the
Planning Commission, as follows:
PLANNING DEPARTMENT CONDITIONS
PRIOR TO ISSUANCE OF A BUILDING PERMIT
1. The applicant shall submit, for review and approval by the Director of
Planning, revised plans which indicate the following:
a. The deletion of the proposed vehicle service entry on the east
elevation.
b. The deletion of the proposed free-standing monument sign.
C. The wall -mounted signs constructed of metal with a flat finish, and the
proposed lighting specifications.
d. The wall surrounding the "auto court" shall be increased to nine feet
in height.
e. Designated employee parking in a location acceptable to adjacent
property owners.
f. Speed controls added to control the intersection at the southwest
corner of the building.
g. An acoustical enclosure for the air compressor.
h. *The use of acoustic tiles of a type which would reduce noise levels a
minimum of 2 dBa measured at the sidewalk fronting the Mission
Village Center.

The Camino Capistrano frontage will be landscaped with large-scale
planting elements and/or the building will be provided with screening
walls to visually buffer all overhead doors.
ONGOING OPERATIONAL CONDITIONS
2. *The tire service operations will be restricted to the use of the latest available
technology air wrenches capable of reducing noise levels a minimum of 2 dBa
measured at the sidewalk fronting Mission Village Center.
*The tire service operations will be conducted with overhead doors in a
completely closed position to further reduce potential off-site noise impacts
to adjoining commercial uses.
4. *Servicing of vehicles outside of the tire center shall be prohibited.
