Resolution Number 94-9-20-5M ' • • • 94-9-20-5 RFSPONSF TO DRAFT PRIMA DRSHECHA GENER AT, DEVELOPMENT PLAN AND DRAFT ENVIRONMENTAL IWACT REPORT (INTERnIUBISDICTIONAL PROJECTREVIEW ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, RESPONDING TO THE COUNTY OF ORANGE ON THE DRAFT PRIMA DESHECHA LANDFILL GENERAL DEVELOPMENT PLAN AND DRAFT ENVIRONMENTAL IMPACT REPORT WHEREAS, the County of Orange has prepared and circulated a Draft General Plan and Environmental Impact Report for Prima Deshecha Canada Landfill which is substantially situated in the southeast section of the City; and, WHEREAS, the California Code of Regulations, Section 15086, requires the Lead Agency (County of Orange) to consult with and request comments on the Draft Environmental Impact Report from Responsible Agencies (City of San Juan Capistrano); and, WHEREAS, on September 13, 1994, the San Juan Capistrano Planning Commission did review and comment on the Draft General Development Plan and Environmental Impact Report and those comments have been considered by the City Council. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby direct the following position to the County of Orange: The Draft Environmental Impact Report should be revised to acknowledge that the City of San Juan Capistrano is a Responsible Agency with discretionary approval power related to determining consistency of the proposed project with the San Juan Capistrano General Plan. 2, The Draft Environmental Impact Report should be significantly revised to disclose fully the visual impact to the City of San Juan Capistrano affects a far larger area of the community than represented in the Draft Environmental Impact Report, is significant, and that the "Reduced Height Alternative" would eliminate that significant impact. 3. The City Council does not support the present proposal for Waste Management Unit 1 and recommends that the project design be revised to incorporate the 'Reduced Height Alternative." I4. The following additional mitigation measures be incorporated into the final Environmental Impact Report: 1- 209 a. Construction of any structures within 200 feet of the City of San Juan Capistrano -designated major ridgelines shall be prohibited and other structures potentially within the view corridor of cities shall require line -of -sight view analysis for review and comment of affected cities. The justification for limiting traffic signal warrant analysis to three intersections on Ortega Highway shall be specified in the Draft Environmental Impact Report. C. The City does not concur with the conclusions of the Draft Environmental Impact Report with respect to traffic impacts. Proposed mitigation is not adequate and therefore, traffic impacts will not be reduced to a level of insignificance. The analysis clearly indicates that the project will have a significant impact on the levels of service at the I-5/Ortega Highway intersection and along Ortega Highway during Year 2000. Additional mitigation is necessary and should be included as follows: (1) The County shall be responsible for either constructing or securing a commitment from the California Department of Transportation to reconstruct Ortega Highway from I-5 to the easterly City limit as a four -lane arterial. (2) The County shall be responsible for either constructing or securing a commitment from the California Department of Transportation to design/reconstruct the I-5/Ortega Highway interchange prior to Year 2000 to maintain a minimum "D" level of service. d. The City does not concur with the conclusions of the Draft Environmental Impact Report with regard to noise impacts. Noise projections in the Draft Environmental Impact Report indicate that truck traffic associated with the project will raise the Community Noise Equivalent Level along Ortega Highway from 68 to 71 Community Noise Equivalent Level. The Draft Environmental Impact Report mistakenly states that all residences along Ortega Highway are below grade and therefore, sufficiently buffeted. The Draft Environmental Impact Report should be revised to correct that error and to specify how a perceptible increase in noise impacts in an area already far above the community standard (60 Community Noise Equivalent Level) should be considered insignificant, and why mitigation measures should not be considered. The conclusion that a grade differential sufficiently buffers noise impact must be documented with on-site acoustic measurement and modeling along the entire length of Ortega Highway. -2- ' e. The Forster Canyon Landfill, which was established and operated by the County, remains unclosed with a potential closing cost projected between 2 to 7.5 million dollars ($2,000,000 - $7,500,000). The Draft Environmental Impact Report should discuss how the County will meet that responsibility before the significant expansion of another landfill. 5. That staff be directed to work with San Clemente, Mission Viejo and the County of Orange as co-sponsors of a Measure "M" funding application for the immediate extension of Antonio Parkway from Ortega Highway north to its present terminus at Oso Parkway.
