Resolution Number 94-6-21-3RESOLUTION NO. 94-6-21-3 I�YYDO zi 475 n MY14111119410r Y: :/u X14 1 :1041 : : SII1 1 : �: r A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING CONCEPTUAL PLANS FOR CAPITAL 24PROVEMENT PROJECT 121, THE INSTALLATION OF AN INTERIM SIDEWALK AND STREET WIDENING AT SAN JUAN CREEK ROAD AND VALLE ROAD WHEREAS, the applicant, the City of San Juan Capistrano, has submitted plans for a capital improvement project to construct an interim sidewalk and road widening at San Juan Creek Road and Valle Road in a Planned Development District with a designation of 5.0 (Public Institutional) on the General Plan Map; and, WHEREAS, this project has been reviewed in accordance with the California Environmental Quality Act and has been determined to be categorically exempt (Class 1) from further environmental review. Class 1 exemptions include minor modifications to existing streets, highways and sidewalks; and, WHEREAS, at its regular meeting of May 24, 1994, the Planning Commission of the City of San Juan Capistrano reviewed Capital Improvement Project 121 and recommended conditional approval to the City Council; and, WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as follows: 1. The proposed project is consistent with the Municipal Code in that San Juan Creek Road is a Secondary Arterial Highway which requires a five-foot sidewalk on both sides, and currently there is no sidewalk on ' either side. The proposed improvements will provide an interim sidewalk providing safe pedestrian access along this portion of the road until the street can be improved to full Municipal Code standards, including a sidewalk on each side of the street. This would occur at the time adjacent properties are developed. 2. The proposed sidewalk and road improvements are consistent with the General Plan in that the circulation element strives "for a more adequate non -vehicular circulation system ... and also seeks to insure that streets and highways are a more pleasing element within the community." The proposed sidewalk and landscaping are consistent with this goal in that the proposed sidewalk will provide much needed pedestrian access from the Chateau San Juan Senior Housing project to the Von's shopping center, while the landscaping, as conditioned, provides a visually improved streetscape along this portion of San Juan Creek Road. 3. The proposed street tree, bradford pear, is more appropriate for right-of-way landscaping than the evergreen pear specified by the street tree master plan because the proposed street tree grows taller and fuller than the specified tree which is slow growing and requires support and shaping to prevent the tree from attaining the appearance of a large shrub. NOW, THEREFORE, BE 1T RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve the conceptual plans for Capital Improvement Project 121, the proposed interim sidewalk and road widening at San Juan Creek Road and Valle Road, subject to the following conditions: Prior to the issuance of a grading permit the applicant shall submit revised plans which indicate the following: 037 038 a A six -foot -wide sidewalk, except under the freeway overpass. b.
