Resolution Number 95-7-18-7416 fief.`i�Ilflill�(�]�i�[��I.�16E�►1 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN -CAPISTRANO, CALIFORNIA, GRANTING AN EXEMPTION FROM THE MORATORIUM TO ALLOW A RODEO, DANCE, CONCERT, AND CARNIVAL, SUBJECT TO APPROVAL OF A SPECIAL ACTIVITIES PERMIT WHEREAS, on September 1, 1992, the City Council placed a moratorium on special events such as rodeos, carnivals, and circuses pending adoption of a City policy; and, WHEREAS, the applicant, Jerry Harris, Rodeo U.S.A., has requested an exemption from the moratorium to allow a rodeo, dance, concert, and carnival at the comer of Junipero Serra Road and Camino Capistrano; and, WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as follows: 1. The proposed request is consistent with the zoning and General Plan designation for the property. 2. The proposed activities meet the provisions in Section 9-3.623 of the City's Municipal Code. 3. The inclusion of conditions of approval regulating hours of operation, site layout, and parking arrangements will provide sufficient controls to eliminate any adverse impacts to nearby residences. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby grant an exemption from the moratorium to allow Rodeo U.S.A., subject to approval of a Special Activities Permit including, but not limited to, the following conditions: 1. The event hours shall be restricted as follows: August 17, 1995: 12 p.m. - 10 p.m. (carnival only) August 18, 1995: 5 p.m. - 12 a.m. (with carnival, amplified music, and pyrotechnics to close by 11:30 p.m.) August 19, 1995: 12 p.m. - 12 a.m. (with carnival, amplified music, and pyrotechnics to close by 11:30 p.m.) August 20, 1995: 12 p.m. - 10 p.m. 417 2. All activities for this event shall be located west of the existing dirt road on the property, with the parking area to be located along the east and south sides of the dirt road as shown on Attachment 2. 3. All parking shall occur on-site. Off-site parking shall only be utilized upon receipt by the City of the property owner's written authorization and when the on-site parking area is full. 4. "No Event Parking" signs shall be located at Calle Chueca, Oso Road, and at business center lots east of the freeway. Business center lots authorized for off-site parking use by the City shall be posted "Additional Event Parking." 5. Applicant shall provide weed removal along the entire perimeter of the property adjacent to the Casitas Capistrano neighborhood to decrease the fire hazard to the residents prior to the opening of any activity associated with the event. 6. Applicant shall provide dust control by administering a light water sprinkling over the entire premises a minimum of once a day for each day of the event. If dust continues to be a problem, City staff may require additional dust control measures. 7. Applicant shall provide adequate security measures, as conditioned by the Orange County Sheriffs Department, including adequate monitoring and control of trespassers across the perimeter boundary from the Casitas Capistrano common areas immediately south of the site.
