Resolution Number 95-5-16-4 318 RESOLUTION NO. 95-5-16-4 ' APPROVAL OF ROUGH GRADING PLAN, TRACT 14398 (CONCORDE DEVELOPMENT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING A GRADING PLAN FOR VESTING TENTATIVE TRACT 14398 IN FULFILLMENT OF CONDITION A.2 OF CITY COUNCIL RESOLUTION NO. 93-4-6-5 (CONCORDE DEVELOPMENT) WHEREAS, the applicant, Concorde Development, 19752 MacArthur Boulevard, Suite 240, Irvine, California, submitted Vesting Tentative Tract Map 14398 to subdivide 99 acres of land into 79 residential lots and three open space lots at the eastern terminus of Camino Las Ramblas, which was approved by the City Council on April 20, 1993; and, WHEREAS, Condition A.2 of Vesting Tentative Tract Map 14398 required Planning Commission and City Council review of the grading plan for consistency with the approved concept grading plan; and, ' WHEREAS, the Planning Commission conducted a duly-noticed public meeting on April 11, 1995, to receive and consider the grading plan; and, WHEREAS, the City Council conducted a duly-noticed public meeting on May 16, 1995, to receive and consider the grading plan. NOW,THEREFORE,BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings and directs staff accordingly: 1. The grading plan is consistent with the approved concept plan in that it is contained within the grading limit line of the concept plan. 2. Prior to rough grading plan permitting, the grading plan shall be modified to ensure that no lot shall drain onto another lot. 3. Prior to rough grading plan approval, drainage design shall be modified to ensure that no lot shall drain onto another lot. 319 BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve the rough grading plan included in this resolution by reference and attached as Exhibit A as fulfillment of Condition A.2 of City Council Resolution No. 93-4-6-5.
