Resolution Number 95-5-2-5259 RESOLUTION NO. APPROVING CONCEPTUAL IMPROVEMENT PLANS FOR THE ROSENBAUM PUMP STATION UPGRADE - CAPffAL IMPROVEMENT PROJECT 94-717 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING CONCEPTUAL IMPROVEMENT PLANS FOR THE ROSENBAUM PUMP STATION UPGRADE (CAPITAL IMPROVEMENT PROJECT 94-717) WHEREAS, the City of San Juan Capistrano, 32400 Paseo Adelanto, San Juan Capistrano, California 92675, submitted an application to improve an existing pump station situated on Assessor's Parcels Nos. 650-071-052 and 650-073-053, which serves that area in the City east of the Interstate 5 freeway, generally known as Village San Juan; and, WHEREAS, on January 25, 1994, the Environmental Review Board confirmed the Planning Director's determination that the project was Categorically Exempt, Class 2, from further environmental review. Class 2 applies to those projects involving the replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity; and, WHEREAS, a public meeting notice denoting the proposal, the time and the location of the March 14, 1995 Planning Commission meeting was mailed to property owners within 300 feet of the project. At that meeting the Planning Commission adopted Planning Commission Resolution No. 95-3-14-3, recommending approval of the project; and, WHEREAS, a public meeting notice denoting the proposal, the time and the location of the May 2, 1995, City Council meeting was mailed to property owners within 300 feet of the project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: 1. General Plan Consistengy - The Rosenbaum Pump Station upgrade is consistent with the General Plan in that it will provide uninterrupted levels of service for the residents of San Juan Capistrano and has been designed to include generous landscaping to prevent views into the site from the nearby residential project. 2. Municipal Code Title 9 (Land Use) Compliance - The project complies with the provisions of Title 9 of the Municipal Code and, as conditioned, will ensure that an attractive environment for the public is maintained after the project is completed. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan ' Capistrano does hereby approve the conceptual plan for the Rosenbaum Pump Station Upgrade, Capital Improvement Project No. 94-717, with the following conditions: -1- 260 1. Prior to construction of the improvements, the landscape plans shall be revised to show the following changes, subject to the approval of the Planning Director: trees; a. a dark green vinyl -clad chain link fence (including support poles); b. trees should not be placed within the right-of-way; C. landscaping shall include three Podocarpus trees and three Pepper d. Creeping Fig vine shall be used for screening of the fencing. 2. Prior to construction of the improvements, an easement shall be recorded to allow the city permission to conduct permanent improvements in the project area. A copy of said easement shall be provided to the City Clerk for inclusion in the project file. PASSED, APPROVED, AND ADOPTED this May . 1995.
