A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, OPPOSING SENATE BILL 17xx (CRAVEN),
EXEMPTING PROJECTS RELATED TO SOLID WASTE HANDLING AND
DISPOSAL AT ORANGE COUNTY LANDFILLS FROM CALIFORNIA
ENVIRONMENTAL QUALITY ACT
WHEREAS, the County of Orange is seeking support from the State Legislature
to be exempted from the California Environmental Quality Act requirements to prepare
environmental impact reports to assess the impacts that would occur due to the
importation of solid waste from areas outside of Orange County; and,
WHEREAS, Senator Craven has introduced on behalf of the County of Orange,
California known as Senate Bill 17xx, which would exempt certain projects related to
solid waste handling and disposal services provided at Orange County Landfills,
including Prima Deshecha, from California Environmental Quality Act environmental
review; and,
' WHEREAS, the State of California has enacted the California Environmental
Quality Act to ensure that projects which adversely impact natural resources and
degrade the quality of life for Californians are appropriately reviewed and conditioned
as necessary to mitigate adverse impacts; and,
WHEREAS, the County of Orange, California operates landfills for the purpose of
solid waste handling and disposal; and,
WHEREAS, one of these County landfills, Prima Deshecha, is located within the
incorporated boundaries of the City of San Juan Capistrano; and,
WHEREAS, the City of San Juan Capistrano supports efforts to protect and
preserve California's natural resources; and,
WHEREAS, this landfill impacts San Juan Capistrano residents due to the traffic,
noise and pollution that it or its users generate; and,

WHEREAS, the County of Orange is not currently in compliance with State
environmental protection laws for the Prima Deshecha landfill and has failed to comply
with a Stipulated Notice of Order for Compliance; and,
WHEREAS, the Importation of Solid Waste is contrary to the intent of the
California Integrated Waste Management Act of 1989, which encourages recycling and
seeks to reduce reliance on solid waste disposal facilities throughout the State of
California; and,
WHEREAS, S1317xx circumvents the California Environmental Quality Act and sets
a dangerous precedent.
WHEREAS, this Bill will be considered by the Senate Government Organization
Committee on April 25, 1995.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Juan Capistrano does hereby adamantly oppose Senate Bill 17xx on the grounds that
it violates the spirit and intent of environmental protection laws designed to protect all
Californians and California's precious natural resources.
BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano is hereby opposed to the County of Orange's effort to import solid waste into
Orange County, an effort contrary to the California Integrated Waste Management Act
of 1989.
BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano calls upon all citizens who support efforts to protect and preserve California's
environment to raise their voices in opposition to this proposed legislation, which denies
the rights of Californians for equal protection under the law.
