RESOLUTION NO. 95-1-3-5
PROTESTING SOLID WASTE IMPORTATION
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, PROTESTING SOLID WASTE IMPORTATION
INTO ORANGE COUNTY LANDFILLS
WHEREAS, the California Legislature enacted the California Integrated Waste
Management Act of 1989 (Assembly Bill 939), establishing aggressive waste reduction requirements
for California cities and counties to prolong landfill life; and,
WHEREAS, the importation of solid waste is philosophically contrary to the intent
of the California Integrated Waste Management Act of 1989; and,
WHEREAS, the Orange County Board of Supervisors and the Orange County
Integrated Waste Management Commission may now consider the importing of solid waste from
other counties, which would consume Orange County landfill space with outlying counties' waste;
and,
' WHEREAS, the importation plan proposes receiving about 5,000 tons per day of
imported waste, generating a new revenue source for the County, but which would be borne by city
constituents in their refuse bills, covering such increased expenses as hauler delays, and in many cases,
longer landfill trips; and,
WHEREAS, the importation plan would be an unfair burden for San Juan Capistrano,
which would have to bear additional adverse impacts of traffic congestion, noise, pollution, litter and
increased maintenance costs for streets, and,
WHEREAS, waste importation from outlying counties poses the potential risk of
enhancing chances for receiving hazardous materials in local landfills, and the resulting increased
chances for groundwater contamination; and,
WHEREAS, sacrificing long-range landfill capacity in the attempt to mitigate near-
term budgetary shortfalls in a mismanagement of our investment in the future, and today's leaders will
be remembered with little kindness by the generations that follow.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San
Juan Capistrano, that solid waste importation into Orange County from outlying counties is
counterproductive and unacceptable, and that the City protests importing solid waste into the County
landfills.
BE IT FURTHER RESOLVED, that the City Manager is hereby directed to cause
this Resolution to be circulated to all other local agencies and County officials.
