Resolution Number 96-4-2-5400 RESOLUTION NO. 96-4-2-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONFIRMING ISSUANCE OF A STATUTORY EXEMPTION AND APPROVING INTER -JURISDICTIONAL PROJECT 96-3, SAN ONOFRE NUCLEAR GENERATING STATIONS SIREN RELOCATION WHEREAS, the San Onofre Nuclear Generating Station has conducted acoustic tests to determine whether existing alert sirens within the City of San Juan Capistrano serving the San Juan Creek residential neighborhoods comply with Federal criteria; and, WHEREAS, the acoustic tests have determined that Siren SJ01 should be relocated to a position along San Juan Creek Road near La Mancha Avenue in order to comply with San Onofre Nuclear Generating Station and Federal criteria; and, WHEREAS, the proposed project has been processed pursuant to Section 9-2.301, Development Review of the City's Municipal Code; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to ' Section 15061 of the California Environmental Quality Act and issued a statutory exemption and caused a Notice of Exemption to be posted pursuant to the City's Environmental Review Guidelines; and has otherwise complied with all applicable provisions of the California Environmental Quality Act; and, WHEREAS, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act and conducted a duly -noticed public meeting on March 12, 1996, pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on the proposed project and recommended approval. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Public Safety Element, because the project provides early warning siren capability to residents consistent with established Federal criteria; and, 2. The proposed project complies with all applicable provisions of the Land Use Code subject to the mitigation measures and conditions of approval contained in this resolution. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan ' Capistrano hereby confirms issuance of a statutory exemption and approves the project subject to the following conditions of approval: -I- 401 1. The proposed location of relocated San Onofre Nuclear Generating Station Siren SJOI shall be at the existing fight pole located approximately 755 feet east of La Mancha on the south side of San Juan Creek Road. I Southern California Edison shall secure the necessary right-of-way encroachment permit from the Engineering Division prior to initiating any work within the San Juan Creek public right-of-way.
