A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, DENYING AN APPEAL OF THE PLANNING
COMMISSION'S JANUARY 23, 1996 DENIAL OF A REQUEST FOR A
CONDITIONAL USE PERMIT TO ALLOW NIGHT LIGHTING AT THE SAN
JUAN HILLS DRIVING RANGE LOCATED AT 32111 SAN JUAN CREEK
ROAD (CONDITIONAL USE PERMIT 95-6/SAN JUAN GOLF, INC.)
WHEREAS, the applicant, Rick Parifio for San Juan Golf, Inc., 32120 San Juan
Creek Road, San Juan Capistrano, California 92675, has appealed the Planning Commission's action
of January 23, 1996 denying a request for approval of a conditional use permit for night lighting of
the San Juan Hills Driving Range, located at 32111 San Juan Creek Road within the Open Space
Recreation (OR) District, designated 2.1 (Open Space Recreation) on the General Plan Map; and,
WHEREAS, this project has been processed and reviewed in accordance with the
California Environmental Quality Act (1970). The City's Environmental Administrator has reviewed
this project and determined that it qualifies for issuance of a mitigated negative declaration; and,
WHEREAS, at its meeting of June 28, 1994, the Planning Commission adopted
Resolution No. PC 94-6-28-1, approving the site plan for the San Juan Hills Driving Range. The
proposal included approval of a variance for 50 -foot poles to support safety netting; and,
WHEREAS, the City Council conducted a duly -noticed public hearing on March 5,
1996 to consider public testimony on the proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby make the following findings:
1. Land uses adjacent to the San Juan Hills Driving Range include light sensitive
medium density housing to the east and the Chateau San Juan senior housing project to the south of
the site. Photometric studies indicate minimal direct light impacts to the San Juan Hills East
neighborhood; however, the effects of glare over the driving range will have a negative impact on the
neighborhood in the form of a "halo" over the driving range. The proposed fights will also have a
negative impact on the Loma and Mesa Vista hillside homes in that the driving range is located at the
base of the hills and is in the foreground of the view of the valley below. The glare from the driving
range would therefore have the potential to significantly impact the views from these homes.
2. The proposed 60 -foot poles located at the north end of the driving range
behind the tee -boxes will each be fitted with three 1,500 -watt metal halide lamps directed southward,
' towards Chateau San Juan. As a result of this configuration, the residents of Chateau San Juan will

be subject to direct glare from the fixtures as well as the glare impacts described in Finding No.
above.
3. The proposed fighting is not consistent with the Community Design Element
of the City's General Plan in that the Community Design Element specifies the minimization of night
fighting along circulation corridors "particularly along Interstate 5." This project, while not directly
adjacent to Interstate 5 is in close enough proximity that the halo effect of the lighting above the
range would be clearly visible from the freeway, at a point which is central and clearly identifiable to
motorists as being in San Juan Capistrano.
4. The proposed fighting is not consistent with the Scenic Highways Element in
that the Scenic Highways Element identifies San Juan Creek Road as a scenic drive and places it
within the scenic corridor of Ortega Highway, which is eligible as a State Scenic Highway. Although
these roads have not been established by resolution as scenic highways and drives, their inclusion
within the Scenic Highways Element clearly establishes their significance as an important visual
resource, and as such should not be subject to development which may have a negative visual impact,
such as that resulting from outdoor recreational lighting.
BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby deny the applicant's appeal of the Planning Commission's action of
January 23, 1996, denying a conditional use permit for night lighting of the San Juan Hills Driving
Range.
