Resolution Number 96-2-20-5292 RESOLUTION NO. 96-2-20-5 ' CI � ; 1► Y: 1\ :►1 � 1� 1 ►l1 :► U k A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING A CAPITAL IMPROVEMENT PROJECT TO RECONSTRUCT A PORTION OF THE EXISTING NORTH RAILROAD PLATFORM DIRECTLY ADJACENT TO THE DEPOT AND TO CONSTRUCT A NEW EXTENSION NORTH OF THE EXISTING PLATFORM (AMTRAK/CITY OF SAN JUAN CAPISTRANO) WHEREAS, the applicants, the City of San Juan Capistrano and the National Railroad Passenger Corporation, attention James P. Booth, Amtrak Engineering, 810 North Alameda, Suite A, Los Angeles, California 90012, have requested approval of a capital improvement project to reconstruct a portion of the existing north railroad platform directly adjacent to the Capistrano Depot, and to construct a new 153 -foot 6 -inch extension north of the existing platform. The project site is located at the western terminus of Verdugo Street, adjacent to the San Juan Capistrano Depot within the Tourist Commercial (CT) District and is designated 3.1 (General Commercial) on the General Plan Map; and, WHEREAS, this project has been processed and reviewed in accordance with the ' California Environmental Quality Act (1970). The City's Environmental Administrator has reviewed this project and determined that it qualifies for issuance of a mitigated negative declaration. All mitigation measures have been included as conditions of approval; and, WHEREAS, at their meeting of November 27, 1995, the Los Rios Review Committee considered Capital Improvement Project Application 95-1106 and provided comments to staff on their belief that the proposed project was appropriate for the area; and, WHEREAS, at their meeting of December 12, 1995, the Cultural Heritage Commission considered Capital Improvement Project Application 95-106 and forwarded a recommendation of approval; and, WHEREAS, at their meeting of January 9, 1996, the Planning Commission considered Capital Improvement Project Application 95-106 and forwarded a recommendation of approval; and, WHEREAS, at their meeting of February 20, 1996, the City Council considered Capital Improvement Project Application 95-106. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find and determine as follows: ' 1. The proposed passenger platform reconstruction and extension is not a significant departure from the existing platform and therefore will not have a detrimental effect on the historic significance of the San Juan Capistrano Depot, or the adjacent Los Rios Historic District. -I- 293 2. The proposed lighting is consistent with the existing lighting on the south platform and will not have a significant impact on the Los Rios Historic District. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve Capital Improvement Project 95-106, to reconstruct a portion of the existing north railroad platform directly adjacent to the depot and to construct a new 153 -foot 6 -inch extension north of the existing platform, subject to the following conditions: *1. Luminaries shall consist of a design which completely shields light sources from all residential properties within the Los Rios Historic District. 2. The northernmost light standard shall be deleted. *3. Light intensity shall generally be within the footcandle range projected by the photometric study subject to approval by the Planning Director or his designee. *4. Design of planned improvements for the north passenger platform shall be compatible with the south passenger platform as determined by the Planning Commission. *5. The City will investigate material alternatives to the tubular steel railing for the proposed handicap access ramp which will comply with ADA requirements, and Orange County Transportation Authority standards, while providing a more historically -compatible design. *6. On-site monitoring shall be provided for al grading and boring by a City - qualified archeologist. The monitor shall establish a procedure for archaeologic resource surveillance and will establish, in cooperation with the City, procedures for temporarily halting or re -directing work, in order to identify, sample, and/or evaluate potential artifacts. In the event any cultural resources/artifacts are encountered, the archeologist will prepare and submit a report detailing their potential significance. The disposition of any cultural resources/artifacts shall be at the discretion of the City of San Juan Capistrano. *Denotes conditions which are mitigation measures contained within the mitigated negative declaration.
