Resolution Number 95-11-21-2128 RESOLUTIONNO. STREETINTENT TO VACATE A PORTION OF VIA ENTRADA, A PUBLIC 1N THE GLENDALEXEDERAIL PLANNED COMMUNITY, TRACTS 13437 AND 13865 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING ITS INTENT TO VACATE A PORTION OF VIA ENTRADA WITHIN TRACT 13865, FOURTEEN HUNDRED FEET SOUTHEASTERLY OF LA NOVIA AVENUE, TO THE TERMINUS OF VIA ENTRADA IN TRACT 13437 (TAYLOR WOODROW HOMES/PACIFIC COMMUNITIES BUILDER) WHEREAS, the City Council finds and determines that a portion of Via Entrada within the Glendale Federal Planned Community can be property vacated. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano as follows: ' 1. The City Council does hereby declare its intention to vacate and close to public use a portion of Via Entrada from 1,400 feet southeasterly of La Novia Avenue, within Tract 13865, to the terminus of Via Entrada in Tract 13437 (Glendale Federal Planned Community), more particularly shown on the map on file in the City Clerk's Office, a copy of which is attached hereto, excepting therefrom a perpetual non-exclusive easement and right-of-way for sewer and public utilities purposes, including specifically, but not by way of limitation, the right to lay, construct, reconstruct, remove and replace, renew, inspect, maintain, repair, improve, relocate and otherwise use, together with incidental appurtenances, connections and structures and other necessary easements for ingress and egress and public utility purposes, and elects by this Resolution to proceed under the provisions of the Streets and Highways Code, Division 9, Part 3, Section 8320 et seq. 2. A public hearing shall be held on the 2nd day of January, at the hour of 7:00 p.m., in the City Council Chamber of the City of San Juan Capistrano, located at 32400 Paseo Adelanto, at which time all persons interested in or objecting to these proceedings shall be heard. 3. This resolution shall be posted in the duly designated posting places within the City of San Juan Capistrano not less than fifteen (15) days prior to the aforesaid public hearing date and published for at least two successive weeks prior to the public hearing. -t- 129 4. At least three (3) of said notices of street vacation shall be placed not more than 300 feet apart and posted conspicuously along the line of the aforesaid street proposed to be vacated at least fourteen (14) days before the date set for the public hearing.
