Resolution Number 96-9-17-4273 RESOLUTION NO. 96-9-17-4 APPROVING ZONE VARIANCE 96-6 - SAN KAN CAPISTRANO COMMUNITY I CENTER AND SPORTS PARK (CAPITAL IMPROVEMENT PROJECT 4511 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING ZONE VARIANCE 96-6 AND THE CONCEPTUAL PLANS FOR THE COMMUNITY CENTER TO BE LOCATED AT THE SAN JUAN CAPISTRANO COMMUNITY CENTER AND SPORTS PARK - CAPITAL IMPROVEMENT PROJECT 451 WHEREAS, the City Council has initiated a program for the design and development of the Community Center to be located at the San Juan Capistrano Community Center and Sports Park on Camino Del Avion; and, WHEREAS, the proposed project has been processed pursuant to Section 9-2.311, Development Review, of the San Juan Capistrano Municipal Code; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act and has determined that the previously - certified Environmental Impact Report prepared for the Open Space Master Plan has addressed the specifics of the proposed Community Center and therefore does not require any further environmental review, and has otherwise complied with all applicable provisions of the California Environmental Quality Act; and, WHEREAS, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act; and, WHEREAS, the Planning Commission conducted a duly -noticed public meeting on June 11, 1996, pursuant to Section 9-2.311 of the Municipal Code to consider public testimony on the proposed capital improvement project and continued their consideration to June 25, 1996; and, WHEREAS, at their meeting of June 25, 1996, the Planning Commission requested the City Council to suspend the review schedule to allow the project architect to prepare revised plans consistent with their actions of June 25, 1996, and complete a final review of said plans prior to formal consideration by the City Council; and, WHEREAS, at their meeting of July 2, 1996, the City Council did confirm the request of the Planning Commission to grant them the opportunity to complete their consideration of the revised plans; and, WHEREAS, at their meeting of August 13, 1996, the Planning Commission ' considered the revised concept development plans prepared by the City's architect in response to their previous comments; and, -1- 274 WHEREAS, the Planning Commission has forwarded the concept plans recommending approval to the City Council, which includes several modifications to the plans, where said recommendation will require consideration of a zone variance to the height limits to permit the recommended full pitch roof for the gymnasium (44 feet); and, WHEREAS, the City's architect has incorporated the modifications to the concept design elevations in accordance with the recommendations of the Planning Commission; and, WHEREAS, the City Council has conducted a duly -noticed public hearing to take testimony on both the zone variance application and the concept development plans. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: LIENEW67MV007MM W. a. There are special circumstances applicable to the property in that this property is a very special component of an overall strategy of improvements directly related to serving the residents and visitors to our City. In preparing development plans for this community center, several elements have been identified for inclusion by the Parks and Recreation Element of the City's General Plan. One such element was the inclusion of a full- service gymnasium. Unlike most large buildings, a gymnasium has certain internal volume requirements to meet anticipated use programs. In order to accomplish this requirement and maintain a rural theme, the ability to accommodate the use and visual appearance will require a building height that will exceed the 35 -foot height limitation. To accommodate the use and a full -pitched roof at the 35 -foot maximum, the pitch of the roof can be no greater than a 2:12. This is extremely flat and not consistent with a rural character building. Second, with such a low pitched roof, the massiveness of the wall elements is created that would be inconsistent with the intent of the City's General Plan and Architectural Design Guidelines. b. The granting of the variance will not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone district in which the property is situated in that this project is a public facility developed to serve the whole community. There are no other properties that have a similar situation as the Community Center and Sports Park and thus the approval of a variance will not constitute a granting of special privileges. C. The variance will not result in development which is inconsistent with the provisions of Title 9 of the Municipal Code in that the proposed uses of the structure and all other provisions of the Municipal Code will be satisfied by the proposed design of the facility. d. The variance will not result in development which is inconsistent with the goals, policies, and objectives of the General Plan in that the proposed use of the facility is fully consistent with the provisions of the Parks and Recreation Element of the General Plan -2- MAN and the Open Space Master Plan adopted by the City as an implementation tool of the General Plan. 2. Concept Development Plans a. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan, and more specifically, the Open Space Master Plan that was designed to implement provisions of both the Open Space and Conservation Element and the Parks and Recreation Element. b. The proposed project complies with all applicable provisions of the Land Use Code subject to the mitigation measures and conditions of approval contained in this resolution. C. The design and location of the facility is consistent with the identified facility needs of the community and the architectural style is generally consistent as conditioned with the rural theme that was selected for the park improvements of the site as conditioned. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby confirm that certified Environmental Impact Report 92-3 fully disclosed the ' impacts of the proposed community center and approves Capital Improvement Project 451 (Community Center) subject to the following conditions: 1. Building Elevations - The final construction plans shall be consistent with the conceptual development plans as submitted for Council consideration. Prior to completion of plan check the Planning Director shall make a written finding that the final construction plans have been prepared and are consistent with the approved concept development plans and the following conditions of approval. 2. Finish Budding Materials - Revised elevations shall reflect use of the following finish building materials for the Community Center: a. Standing seam galvanized metal roof, as proposed (all sloped roofs). b. Wood siding with horizontal slats for those portions of the gymnasium, and full wood siding for the remaining portion of the community center using a shiplap design as proposed except for a three-foot (3') high stucco splash wall at the base of the building walls. If stucco is not compatible, the architect shall make recommendations to the City Council for an alternate material finish. C. The finish surface for non -wood -sided surfaces shall be a smooth ' Mission trowel finish. -3- 276 Historic Depiction Program - Said program shall consist of the following elements: a. The Historic Depiction Program shall include a photo display of historical agricultural uses on property within the Capistrano Valley (pre -1950). b. The photo display should be located in a prominent area. C. Endorse the use of plaques and photographs as part of the Historic Depiction Program. The location and text of the plaques to be subject to Cultural Heritage Commission approval. d. Sub -conditions "a" - "c" shall be reviewed and approved by the Cultural Heritage Commission. e. The landscape plan shall include the use of citrus trees (preference Orange) for the grove concept located between the parking lot and the gymnasium, adjacent to the courtyard. Defer the donor recognition program to the City Council. 4. Landscape Plan - The final landscape plan shall be revised consistent with the following conditions: a. The plan shows tree plantings immediately adjacent to the parking lot lights. These locations shall be evaluated to insure that light from the fixtures as depicted on the photometric plans will still cover the areas shown on the lighting plan. b. The protection of hardscape surfaces within the parking lot and pedestrian walkways from tree roots shall be reinforced with the installation of root barriers between any tree and a hardscape surface. C. Al trees shall be located a minimum ten (10') feet from the Community Center building. d. All the above modifications to the concept plan including identification of proposed species and initial planting size and compliance with the provisions of Section 9-3.617 (Water Conservation Landscape) of the Municipal Code. 5. Lighting Plan - The lighting plan shall be revised to include provisions for security lighting in the parking lot and pedestrian walkway lighting consistent with the design standards of the revised "Exterior Lighting" standards approved by the City Council at their meeting of June 4, 1996. Security lighting shall consist of one-third of the parking lot lights using a dusk to dawn photocell, along with lights over all exit doors. Said final design shall be subject to review and approval of the Planning Director prior to release of plans for solicitation of bids. -4- 277 a. The trash enclosure may be relocated in such a manner if it is ' determined that it will create an odor source at the main entry to the Community Center. Said determination shall be made upon a review of the service operations for the center and evaluation of any alternate design that will accomplish this objective.
