Resolution Number 05-10-04-01RESOLUTION NO. 05-10-04-Oi A RESOLUTION OF THE CITY COUNCIL OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING THAT THE CITY OF SAN JUAN CAPISTRANO IS SUBJECT TO THE PROVISION OF PUBLIC RESOURCES CODE, DIVISION 17, "GEOLOGIC HAZARD ABATEMENT DISTRICTS" TRACTS 15609 and 14196 (EXCEPTING THERE FROM TRACT 15686), (SJD DEVELOPMENT) (PACIFICA SAN JUAN). WHEREAS, on August 15, 1995, the City Council of the City of San Juan Capistrano adopted Ordinance No. 768, codified into the Municipal Code Section 9-3.545, Soils Subsidence Remediation Program of Title 9, Article 5, "Land Use"; and WHEREAS, City of San Juan Capistrano Municipal Code Title 9, Article 5, Section 9-3.545, requires all new development within the City where geologic risks exist to establish a geologic hazard abatement district; and WHEREAS, Tentative Tracts15609 and 14196 (excepting there from Tract 15686), (SJD DEVELOPMENT) (Pacifica San Juan Community Association) are subject to said Municipal Code requirements to establish a geologic hazard abatement district. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Juan Capistrano does hereby declare the City of San Juan Capistrano to be subject to the provisions of the Public Resources Code, Division 17 "Geologic Hazard Abatement Districts' and does hereby direct the City Clerk to forward a copy of this to the Office of the State Controller.
