RESOLUTION NO. 97-5-6-6
AMENDMENT TO LOS RIOS PRECISE PLAN -
PASEO ADELANTO NORTH EXTENSION ALIGNMENT STUDY
(CAPITAL IMPROVEMENT PROJECT 96-137)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, CERTIFYING A MITIGATED NEGATIVE
DECLARATION AND APPROVING AN AMENDMENT TO THE LOS RIOS
PRECISE PLAN AND CAPITAL IMPROVEMENT PROJECT 96-137 (PASEO
ADELANTO NORTH EXTENSION ALIGNMENT STUDY)
WHEREAS, on August 6,1996, the City Council directed staff to prepare and process
amendments to the Los Rios Precise Plan and preliminary alignments for the Paseo Adelanto North
extension; and,
WHEREAS, the City has developed and evaluated an amendment to the Los Rios
Precise Plan Circulation Element to reduce the planned geometric section for Paseo Adelanto from
a forty -foot (40') urban section to a twenty -eight -foot (28') urban section, and has developed three
alternative alignments for the southern section and three alternative alignments for the northern
section which consider right-of-way acquisition (public and private), historic district compatibility,
tree preservation, and public cost; and,
WHEREAS, the proposed project has been processed pursuant to Section 9-2.301,
Development Review of the Municipal Code; and,
WHEREAS, the Environmental Administrator has reviewed the project pursuant to
Section 15061 of the California Environmental Quality Act and has issued a Negative Declaration and
caused a Notice of Negative Declaration to be posted pursuant to the City's Environmental Review
Guidelines, and has included all mitigation measures herein as conditions of approval, and has
otherwise complied with all applicable provisions of the California Environmental Quality Act; and,
WHEREAS, the Cultural Heritage Commission conducted a duly -noticed public
meeting on January 28, 1997, pursuant to Section 9-2.313 of the Municipal Code to consider public
testimony on the proposed project and has recommended conditional approval; and,
WHEREAS, the Transportation Commission conducted a duly -noticed public meeting
on February 14, 1997, pursuant to Section 9-2.313 of the Municipal Code to consider public
testimony on the proposed project and has recommended conditional approval; and,
WHEREAS, the Planning Commission conducted a duly -noticed public hearing on
April 8, 1997, pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on
the proposed project and has recommended conditional approval.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby make the following findings:
1. The proposed project is consistent with the policies and objectives of the San
Juan Capistrano General Plan, specifically, the Circulation Element because it would result in
implementation of a planned road connection; and,
2. The proposed project complies with all applicable provisions of the Land Use
Code subject to the mitigation measures and conditions of approval contained in this resolution; and,
3. The proposed project is consistent with the policies and objectives of the Los
Rios Precise Plan, including the Circulation Element which proposed the northerly extension of Paseo
Adelanto as the primary access to the Los Rios Precise Plan District.
BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby:
Approve a Mitigated Negative Declaration.
2. Approve an amendment to the Los Rios Precise Plan Circulation Element
reducing the planned geometric section for Paseo Adelanto from a forty -foot (40') commuter street
to a twenty -eight -foot (28') local street section.
Select the southern segment - alternative alignment #2.
4. Select the northern segment - alternative alignment #2.
5. Establish a geometric design for Paseo Adelanto to include a conventional
street section (with enhanced brick paver or exposed aggregate sidewalk) which transitions to a rural,
historically -compatible design (roll curb with slotted drain) at the Ramos Street and Street "A"
intersections.
6. Direct staff to retain the Los Rios Street connection to Del Obispo Street until
such time that Street "A", as planned by the Los Rios Precise Plan Circulation Element, is constructed
and operational.
The preceding are subject to the following mitigation measures:
Mitigation Measures
1. The City will retain a professional arborist to evaluate the condition of existing
trees within the study area limits, and provide recommendations as to the most suitable specimen trees
for preservation.

2. The City will design the alignment for the Paseo Adelanto north extension in
such a manner as to preserve those trees identified in the arborist's report. In cases where the ultimate
alignment requires the removal of such trees, the City will include landscaping provisions in the final
improvement plans to replace such trees in kind.
3. The City will assure that the contractor will be required to retain the services
of a Society of Professional Archaeologists -certified archeologist who will monitor all grading and
excavation for potential impacts on cultural resources including archeological, paleontological, and
historic resources.
4. Prior to issuance of the notice of proceed, the City's project manager will
require that the contractor provide an executed contract for services with a Society of Professional
Archaeologists -certified archeologist including a scope of work which provides for comprehensive
monitoring, a contingency for assessment, recovery, and/or evaluation and the preparation of a
technical memoranda or report. In the event cultural resources are encountered during grading, the
monitor may cease grading operations, consistent with City Council policy, to allow for the
assessment, recovery, and/or evaluation of any cultural resources.
