Resolution Number 97-4-1-2229 RESOLUTION NO. 97-4-1-2 APPROVING WAIVER OF TENTATIVE PARCEL MAP 97-128 (HETOS/BOEHRINGER) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING A REQUEST FOR A WAIVER OF TENTATIVE PARCEL MAP 97-128, PERMITTING THE FILING OF A FINAL PARCEL FOR PROPERTY LOCATED AT 32201 PEPPERTREE BEND (IETOS/BOEHR LAGER) WHEREAS, the applicants, William Boehringer and David Hetos, 3535 East Pacific Coast Highway, Suite 307, Corona Del Mar, CA 92652, have requested approval of a waiver of Tentative Parcel Map 97-128, permitting the filing of a final parcel map. The proposed parcel map would re -subdivide two parcels which had previously been consolidated by Lot Line Adjustment 87- 10593-102. The project site is a 2.48 -acre parcel located at 32201 Peppertree Bend; and, WHEREAS, this project has been processed and reviewed in accordance with the Califomia Environmental Quality Act (1970). The City's Environmental Administrator has reviewed this project and determined that it is exempt (Class 15) from further environmental review. Class 15 exemptions include minor land divisions, and, WHEREAS, the City Council conducted a duly -noticed public meeting on April 1, 1997, to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: 1. The Tentative Map process notwithstanding, the proposed project is otherwise subject to the development review process and conditions of Chapter 2 of Title 9 of the Municipal Code in that future single family residences constructed on site will be subject to all of the development standards of the Large Estate District, including setbacks and building height. 2. The proposed lots will each exceed the minimum one -acre lot size for the Large Estate (EL) District. Improvements for floodwater drainage control, improved public roads, sanitary sewer facilities, water supply, environmental protection, and parkland requirements were all considered during the review of Tract 10593, and assume that the subject site would be developed as two building sites. Wel BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve the waiver of Tentative Parcel Map 97-128 permitting the filing of a final map.
