Resolution Number 98-1-6-2279 RESOLUTION NO. 99-1-6-2 INTENT TO VACATE VILLAGE ROAD, A PUBLIC STREET IN THE VILLAGE SAN JUAN COMMUNITY A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING ITS INTENT TO VACATE VILLAGE ROAD, A PUBLIC STREET WITHIN THE VILLAGE SAN JUAN COMMUNITY, FROM THE BOUNDARY OF TRACT 7671 AT THE INTERSECTION OF RANCHO VIEJO ROAD TO THE WESTERLY RIGHT-OF- WAY LINE OF TRABUCO CREEK ROAD AT THE INTERSECTION OF VILLAGE ROAD WHEREAS, the City Council finds and determines that Village Road, a public street within the Village San Juan community can be properly vacated. NOW, THEREFORE, BE rr RESOLVED, by the City Council of the City of San Juan Capistrano as follows: I . The City Council does hereby declare its intention to vacate and relinquish public use of Village Road from the boundary of Tract 7671 at the intersection of Rancho Viejo Road to the westerly right-of-way of Trabuco Creek Road at the intersection of Village Road, more particularly shown on the map attached hereto as Exhibit A, excepting therefrom a perpetual non- exclusive easement and right-of-way for sewer, storm drain, traffic signal, and public utilities purposes. Including specifically, but not by way of limitation, the right to lay, construct, reconstruct, remove and replace, renew, ::zsp" , maintain, repair, improve, relocate and otherwise use, together with incidental appurtenances, connections and structures above and below the surface, and other necessary easements for ingress and egress and public utility purposes, and elects by this Resolution to proceed under the provisions of the Streets and Highways Code, Division 9, Part 3, Section 8320, et seq. 2. The City shall transfer ownership of the street lights and all related connections, structures and appurtenances along and in Village Road, including all liability, costs and maintenance, to San Diego Gas & Electric Company. 3. A hearing shall be held on the 3rd day of February, at the hour of 7:00 p.m., in the Chamber of the City Council of the City of San Juan Capistrano, located at 32400 Paseo Adelanto, at which time all persons interested in or objecting to these proceedings shall be heard. 4. This resolution shall be posted in the duly designated posting places within the City of San Juan Capistrano not less than fifteen (15) days prior to the aforesaid hearing date or published for at least two (2) successive weeks prior to the hearing.
