Resolution Number 97-12-2-8245 RESOLUTION NO. 97-12-2-8 0111ely1: a t 1e u. 1 Lmlvv 31 Ixel WN1 w WaRel KA T14 I to Ic lWal-alk.111c"MIMMIR", Me A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONFIRMING A MITIGATED NEGATIVE DECLARATION FOR REZONE 97-6 AND ARCHITECTURAL CONTROL 97-7, A PROPOSED OUTPATIENT MEDICAL FACILITY LOCATED ON CAMINO CAPISTRANO NORTH OF JUNIPERO SERRA (KAISER PERMANENTE) WHEREAS, the applicant, Kaiser Permanente, attention Nancy Burke, 393 East Walnut Street, Pasadena, California 91188, has submitted a request to rezone an approximately four - acre site from Growth Management (GM) to Commercial Office (CO), and has submitted an architectural control application to allow the development of a 41,000 -square -foot outpatient medical facility located along the east side of Camino Capistrano, approximately 800 feet north of Junipero Serra Road; and, WHEREAS, this proposal has been reviewed in accordance with the California Environmental Quality Act (CEQA, 1970). On October 14, 1997, the City's Environmental Administrator reviewed this proposal and determined that it qualifies for issuance of a mitigated negative declaration, and all mitigation measures are included as conditions of approval in this resolution; and, WHEREAS, on November 12, 1997, the Planning Commission held a duly -noticed public hearing to consider testimony both in opposition to, and in favor of, a mitigated negative declaration pertaining to Rezone 97-6 and Architectural Control 97-7, and forwarded a recommendation of approval to the City Council; and, WHEREAS, on December 2, 1997, the City Council held a duly -noticed public hearing to consider testimony both in opposition to, and in favor of, a mitigated negative declaration pertaining to Rezone 97-6 and Architectural Control 97-7. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find that the mitigation measures contained in the mitigated negative declaration, as issued by the City's Environmental Administrator, will reduce potentially significant environmental impacts to a level of insignificance. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano confirms a mitigated negative declaration, subject to the following mitigation measures: 1 Mitigation Measure #1 - Prior to issuance of any grading or building permit, the applicant shall submit a detailed drainage report which evaluates drainage areas, stormwater runoff, -1- E and existing and proposed stormwater drainage facilities, to the satisfaction of the City Engineer. Prior to issuance of any building or grading permits, the City Engineer or his designee shall determine that the existing public stormwater drainage facilities potentially impacted by the project are adequate to accommodate all drainage associated with the subject proposal. The City Engineer may require upgrade of the existing public stormwater drainage facilities in order to accommodate the project's runoff. • Ij Mitigation Measure 42 - During grading operations, the site shall be periodically wetted down and maintained in a condition which minimizes the production of fugitive dust emissions (PMIO) Mitigation Measure #3 - Prior to issuance of a grading permit, the applicant shall submit dust control plans/procedures for managing/reducing dust and PM,, emissions associated with grading and construction to the satisfaction of the Planning Director or his designee. Plans/procedures for PM,, emissions reduction will be consistent with the South Coast Air Quality Management District Rule 403 and may include use of soil binders, truck washing, street sweeping, and regular vehicle maintenance. AR&I 01 IV KIN1 Mitigation Measure #4 - The project shall be responsible for designing and constructing entrance and frontage improvements consistent with the recommendations of a traffic report prepared pursuant to Administrative Policy 310, subject to review and approval by the City Engineer. Based on the traffic report recommendations, improvements may include widening Camino Capistrano to accommodate southbound left -turn movements into the site. Prior to issuance of any building permit, the applicant shall deposit with the City a $100,000 surety for future public improvements as identified in the traffic study. The applicant will have prepared and submitted for City approval plans for the required entrance and frontage improvements within 60 days of building permit issuance for City Engineer review and approval. Prior to occupancy permit, the project will have completed construction of all entrance and frontage improvements to the satisfaction of the City Engineer or his designee. Mitigation Measure #5 - The project shall be responsible for designing and constructing any required improvements to the intersection of Camino Capistrano and Junipero Serra Road consistent with the recommendations of a traffic report prepared pursuant to Administrative Policy 310, subject to review and approval by the City Engineer. Based on the traffic report recommendations, improvements may include widening Camino Capistrano to extend the southbound left -turn from Camino Capistrano to Junipero Serra. Prior to issuance of any building permit, the applicant shall deposit with the City a $100,000 surety for future public improvements as identified in the traffic study. The applicant will have prepared and submitted for City approval plans for the required entrance and frontage improvements within 60 days of building permit issuance for City Engineer review and approval. Prior to occupancy permit, the project will have completed construction of all intersection improvements to the satisfaction of the City Engineer or his designee. -2- 247 Mitigation Measure #6 - The project shall include the provision of a low-lying earthen berm and dense landscape hedge, and/or wall, approximately three feet in height, along the westerly property edge bordering the proposed parking lot in order to visually screen parking from Camino Capistrano. Any wall shall be designed to be architecturally compatible with the proposed building architecture. Mitigation Measure #7 - Prior to issuance of any occupancy permit, the project shall complete the installation of all project landscaping with particular attention to major landscape elements along Camino Capistrano. Trees along Camino Capistrano shall be consistent with the City's Street Tree Master Plan, which establishes Pine species for that Corridor. Trees along Camino Capistrano shall have a minimum height of eight feet (8) and consist of a mix of minimum thirty -six- inch (36") and forty -eight -inch (48") box specimens. Mitigation Measure #8 - All on-site utilities shall be undergrounded consistent with the Title 9, Chapter 4 of the Land Use Code to the satisfaction of the Planning Director. Mitigation Measure #9 - Prior to issuance of a grading permit, the applicant will retain the services of a Society of Professional Archaeologists -certified archaeologist who will monitor all grading and excavation for potential impacts on cultural resources including archaeological, paleontological, and historic resources. The applicant will provide an executed contract for services with a Society of Professional Archaeologists -certified archaeologist including a scope of work which provides for comprehensive monitoring; a contingency for assessment, recovery, and/or evaluation; and, the preparation of a technical memoranda or report. In the event cultural resources are encountered during grading, the monitor may cease grading operations, consistent with City Council policy, to allow for the assessment, recovery, and/or evaluation of any cultural resources.
