Resolution Number 97-11-4-2165 RESOLUTION NO. 97-11-4-2 1997 UPDATE OF SPECIFIC DEVELOPMENT PLAN 78 -1 - LOS RIOS PRECISE PLAN A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING A STRATEGY AND PROCESS FOR THE 1997 UPDATE OF SPECIFIC DEVELOPMENT PLAN 78-1, LOS RIOS PRECISE PLAN (LOS RIOS HISTORIC DISTRICT) WHEREAS, the City Council hereby initiates an update of the Los Rios Precise Plan and proposes to establish an overall strategy, and planning process, and hereby directs staff to prepare appropriate studies and amendments as required by the Council -established overall strategy, and planning process; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and determined that the planning study does not constitute a project as defined by CEQA; and at such time that the City have prepared draft comprehensive amendments to the Precise Plan, the City will need to conduct environmental review to comply with CEQA; and, WHEREAS, the City Council has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, WHEREAS, the City Council has conducted a duly noticed public meeting pursuant to Section 9-2.313 of the Municipal Code to consider testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: The City Council seeks to establish a planning strategy which seeks to maximize the advantages of the Committee process while providing extensive public involvement, especially for residents and property owners of the Los Rios neighborhood. The City Council seeks to establish an effective strategy which incorporates a two phase process with early public work sessions with standing Commissions and an Advisory Committee followed by public hearings on an updated Specific Plan; and, The City Council seeks to establish a public review process which provides extensive public involvement in the context of a timely process. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano hereby: 166 1. Establishes a seven -person Los Rios Advisory Committee comprised of two City Council Members; two Planning Commissioners, and one (1) commissioner each from the Parks, Equestrian, & Recreation Trails Commission, Transportation Commission, and Cultural Heritage Commission. 2. Establishes the following general framework for the planning process to update the Los Rios Precise Plan: Step 1: At City Council direction, staff completes issue identification process through public work sessions with each of the standing Commissions and residents and property owners within the Los Rios Historic District. Step 2: The City Council's appointed members(s) form the Advisory Committee (i.e., two City Council members, two Planning Commissioners, and one commissioner from each of the other three Commissions). Staff prepares and presents an Issues and Options Working Paper to the Advisory Committee for policy direction. Step 3: Staff and Advisory Committee prepare draft updates to the Los Rios Precise Plan review and recommendation to the City Council. Step 4: The City Council reviews and revises the proposed updates to the Los Rios Precise Plan for the formal public hearing process. — Step S: The City's standing Commissions conduct formal public hearings on the updated Los Rios Precise Plan. Step 6: The City Council conducts formal public hearings and adopts the updated Los Rios Precise Plan. PASSED, APPROVED, AND ADOPTED this 4th day of November 1997. ATTEST: ej CITY CLE DAVID M.
