APPROVING SUBMITTAL OF APPLICATION TO THE
STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE
HOME INVESTMENT PARTNERSHH' (HOME) PROGRAM
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, AUTHORIZING THE SUBMITTAL OF AN
APPLICATION TO THE CALIFORNIA STATE DEPARTMENT OF HOUSING
AND COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE HOME
INVESTMENT PARTNERSHIPS PROGRAM; AUTHORIZING EXECUTION OF
A STANDARD AGREEMENT IF SELECTED FOR FUNDING AND ANY
AMENDMENTS THERETO; AND, ANY RELATED DOCUMENTS
NECESSARY TO PARTICIPATE IN THE HOME INVESTMENT
PARTNERSHIPS PROGRAM AND THE COMMITMENT OF PROPERTY FOR
THE CONSTRUCTION OF RENTAL HOUSING (LITTLE HOLLYWOOD)
WHEREAS, the City of San Juan Capistrano, a political subdivision of the State of
Calfiornia, wishes to apply for and receive an allocation of funds through the HOME Investment
Partnerships Program (hereinafter referred to as "HOME"); and,
WHEREAS, the California Department of Housing and Community Development
(hereinafter referred to as the "Department") has issued a Notice of Funding Availability for the
HOME program and is authorized to approve funding allocations which will be made available
directly through the United States Department of Housing and Urban Development (HUD) to be used
for the purposes set forth in Title II of the Cranston -Gonzalez National Affordable Housing Act of
1990, the implementing regulations set forth in Title 24 of the Code of Federal Regulations, Part 92,
and Title 25 of the California Code of Regulations commencing with Section 8200; and,
WHEREAS, the City of San Juan Capistrano wishes to submit an application to
obtain from the Department an allocation of HOME funds; and,
WHEREAS, the proposed project and program are consistent with the policies and
objectives of the San Juan Capistrano General Plan; and,
WHEREAS, the proposed project is consistent with the policies and objectives of the
San Juan Capistrano Housing Element; and,
WHEREAS, the City of San Juan Capistrano acquired parcels 121-142-01, 121-142-
07 and 649-281-05, commonly referred to as Little Hollywood, for the purpose of providing
affordable rental housing within the City, and,
WHEREAS, on March 20, 1984, the City transferred ownership of parcels 121-142-
01, 121-142-07 and 649-281-05 to the San Juan Capistrano Community Redevelopment Agency for

the purpose of implementing the rehabilitation and new construction of the Little Hollywood
affordable rental housing units; and,
WHEREAS, 26513 Mission Street, 26519 Mission Street, 26511 Mission Street,
26510 Mission Street, 26581 Mission Street, 26599 Mission Street, 26595 Mission Street, 26590
Mission Street and 26580 Ramos Street are rental housing units located within the Little Hollywood
project; and,
WHEREAS, the City re -affirms its commitment to support the San Juan Capistrano
Community Redevelopment Agency in its dedication of the Little Hollywood properties (26513
Mission Street, 26519 Mission Street, 26511 Mission Street, 26510 Mission Street, 26581 Mission
Street, 26599 Mission Street, 26595 Mission Street, 26590 Mission Street and 26580 Ramos Street)
as low- and moderate -income rental housing for a period of not less than 20 years pursuant to the
State of California Housing and Community Development Department Home Investment Partnerships
(HOME) Program.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby find and determine as follows:
I . The City of San Juan Capistrano shall submit to the Department an application
to participate in the HOME program in response to the Notice of Funding Availability issued on
August 13, 1997, which will request a funding allocation for the following activities:
a. Rental New Construction - The project consists of the demolition and
reconstruction of nine single-family bungalow -style rental units. All nine units are located in
a contiguous area located within the City of San Juan Capistrano and are commonly known
as: 26513 Mission Street, 26519 Mission Street, 26511 Mission Street, 26510 Mission Street,
26581 Mission Street, 26599 Mission Street, 26595 Mission Street, 26590 Mission Street,
and 26580 Ramos Street.
The City will utilize HOME Program monies to fund its Little
Hollywood new construction project to pay for the cost of the following: (1) demolition of
nine substantially deteriorated single-family rental units; (2) replacement of the nine single-
family rental units with nine newly -constructed single-family rental units, (3) contracting with
an individual or firm to provide construction management oversight services for the
demolition and construction of nine units; (4) pay for the cost of design work including, but
not limited to, architectural and engineering work for the construction of the nine rental units;
(5) provide for temporary relocation of existing tenant households, (6) on-site improvements
directly related to the construction of the rine single-family units, and, (7) environmental
studies.
b. Owner -Occupied Housing Rehabilitation Prop -ram - This program will
provide secured, zero percent interest rehabilitation loans to eligible low- and moderate -
income households that are primary elderly. The loan will cover the cost of making necessary
health and safety repairs to HOME -eligible housing units and associated eligible HOME

Program soft costs such as credit reports, appraisals, application processing fee, inspection
service fees and specifications engineering costs, recording fees, etc., that are directly related
to the loan for the property being rehabilitated with HOME Program Funds.
2. If the application for funding is approved, the City of San Juan Capistrano
hereby agrees to use the HOME funds for eligible activities in the manner presented in the application
as approved by the Department and in accordance with regulations cited above. It also may execute
any and all other instruments necessary or required by the Department of HUD for participation in
the HOME program.
3. The City of San Juan Capistrano authorizes George Scarborough, City
Manager, to execute in the name of the City of San Juan Capistrano, an application, the Standard
Agreement and all other documents required by the Department or HUD for participation in the
HOME program, and any amendments thereto.
