INITIATION OF GENERAL PLAN AMENDMENT STUDY- DELETION
OF "3.0 NEIGHBORHOOD CONVENIENCE ENTER"
(ORTEGA HIGHWAY AND EASTERLY CITY LIMITS)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, INITIATING A GENERAL PLAN AMENDMENT
STUDY TO DELETE THE "3.0 NEIGHBORHOOD CONVENIENCE CENTER"
COMMERCIAL DESIGNATION NEAR THE ORTEGA HIGHWAY AND
AVENIDA SIEGA INTERSECTION, AS INDICATED ON THE GENERAL
PLAN LAND USE COMPOSITE MAP
WHEREAS, the City Council, at their meeting of June 17, 1997, directed staff to
agendize initiation of an a General Plan Amendment which would delete an existing "3.0,
Neighborhood Convenience Center" designation shown on the General Plan Land Use Composite
Map and described in text of the Land Use Element, and located near the intersection of Ortega
Highway and Avenida Siega; and,
WHEREAS, the General Plan Land Use Composite Map designates a "3.0
Neighborhood Convenience Center" generally located on Ortega Highway in proximity to the easterly
limits of the City; and,
WHEREAS, the General Plan Land Use Element includes a description of the specific
"3.0, Neighborhood Convenience Center" designation and the text states that, "The neighborhood
convenience center has been allocated a land area of approximately 4 to 8 acres. The commercial
facility located easterly on the Ortega Highway is to serve only limited convenience needs and
should be approximately 2 acres"; and,
WHEREAS, Section 9-2.102, of the Land Use Code grants the City Council sole
authority and discretion to initiate General Plan Amendments; and,
WHEREAS, the Environmental Administrator has reviewed the project pursuant to
Section 15070 of the California Environmental Quality Act (CEQA) and determined that the project
is statutorily exempt from the provisions of the California Environmental Quality Act (CEQA); and,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby make the following findings:
1. The land use and traffic circumstances of that area of the City in the vicinity
of the easterly City limit and Ortega Highway, and more specifically in the vicinity of that area
designated "3.0, Neighborhood Convenience Center" by the General Plan Land Use Composite Map,
have changed so as to warrant consideration of possible amendments to the General Plan.

2. The General Plan Amendment process represents the most appropriate
mechanism for evaluating the land use policy issues related to the current "3.0, Neighborhood
Convenience Center" designation along Ortega Highway.
BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby direct staff to begin preparation of a General Plan Amendment analysis and
recommendations with respect to the "3.0, Neighborhood Convenience Center" designation shown
on the General Plan Land Use Composite Map and described in text of the Land Use Element, and
located near the intersection of Ortega Highway and Avenida Siega.
