Resolution Number 98-12-15-7439 RESOLUTION NO. 98-12-15-7 DETERMINING CONSISTENCY WITH CIRCULATION ELEMENT FOR NORTHWARD EXTENSION OF ALIPAZ STREET - CAMINO CAPISTRANO, JUNIPERO SERRA AND OSO ROAD (TMC SAN JUAN, LLC/SYCAMORE COMMONS AND SILVERADO SENIOR LIVING) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DETERMINING THE CONSISTENCY OF ALIPAZ ALTERNATE ROADWAY ALIGNMENT STUDIES WITH THE GENERAL PLAN CIRCULATION ELEMENT - CAMINO CAPISTRANO, JUNIPERO SERRA AND OSO ROAD (TMC SAN JUAN, LLC/SYCAMORE COMMONS AND SILVERADO SENIOR LIVING) WHEREAS, the applicant, Michael Hall, on behalf of TMC San Juan, LLC, 2 Corporate Plaza, Suite 200, Newport Beach, CA 92660, has requested that the City make a determination of consistency of alternate roadway alignment studies with the General Plan Circulation Element; the affected roadways are Camino Capistrano, Junipero Serra, and Oso Road; and, WHEREAS, this project has been processed and reviewed in accordance with the California Environmental Quality Act (1970). The Environmental Administrator has determined that this proposal is statutorily exempt (Section 15262, Feasibility and Planning Studies) from further environmental review; and, WHEREAS, at a joint meeting on November 24, 1998, the Planning Comrr;ssion and the Transportation Commission conducted a public meeting to consider testimony on the proposed Alipaz Street northward extension road alignments and recommended that Alternative B, which crosses Trabuco Creek at Oso Road, is the most feasible. The rank of the remaining three alignments, each of which crosses the railroad tracks and Trabuco Creek at Junipero Serra Road, is as follows: Alternative Rankine A 2 D 3 C 4 WHEREAS, at its meeting on December 15, 1998, the City Council conducted a duly -noticed public meeting to consider public testimony on the proposed road alignments. NOW, THEREFORE, BE IT RESOLVED, that the City Council ofthe City of San Juan Capistrano does hereby make the following findings: -1- 440 1. Alternative B is the most desirable of the four alternatives due to its compliance with the Circulation Element of the General Plan, minimal visual impacts, relative low cost, and minimal impacts to adjacent property owners. 2. Alternative A is the second most desirable alternative. Alternative A's smooth transition into Alipaz Street on the west side of the creek eliminates the intersections that are part of the Alignments C and D, which would increase capacity of the road. Alternative A's weak points, relative to Alternative B, are its cost, visual impacts and loss of adjacent property owner's land due to extensive use of 2:1 slopes. 3. Alternatives C and D are relatively equal with regard to consistency with the Circulation Element. Each alternative proposed an extension ofJunipero Serra Road to Alipaz Road on the west side of the creek, and each also proposes an extension beyond Alipaz, which is not included in the Circulation Element, and an intersection at Alipaz, which has the potential to impact traffic capacity. Each proposal is also relatively equal with regard to impacts to adjacent land. Because of its use of two shorter bridge, Alternative D may offer a slight advantage with regard to visual impacts. This advantage would vary based on the grading and landscape treatment of the embankment separating the two bridges. Alternative D is the third most desirable alternative. 4. Due to its visual impacts, and impacts to adjacent property owners, and land of benefits relative to the other three alternatives, Alternative C is the least desirable alternative. BE IT FURTHER RESOLVED, that the City Council does hereby adopt the following ranking of the four proposed alternative alignments: (1) Alternative B (2) Alternative A (3) Alternative D (4) Alternative C PASSED, APPROVED, AND ADOPTED this 15th day of December , 1998.
