Resolution Number 98-12-1-4KfiVA RESOLUTION NO. 98-12-1-4 FEE SCHEDULE - INSPECTION, DUPLICATION, TAPE RECORDINGS OF OFFICIAL MEETINGS AND PURCHASE OF CITY DOCUMENTS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING PROCEDURES AND FEE SCHEDULE FOR VARIOUS CITY DOCUMENTS REQUESTED BY THE PUBLIC AND REPEALING RESOLUTION NO. 90-11-20-4 WHEREAS, the City receives numerous requests from the general public to inspect and purchase various City documents; and, WHEREAS, the cost to the City for providing such service is considerable and should be reimbursed to the City. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano that the following procedural rules and regulations are adopted in accordance with the California Public Records Act, Chapter 3.5, Division 7, Title 1, of the Government Code of the State of California, Paragraph 6250, et seq., and the Brown Act, Government Code Section 54953.5(b), with regard to making records available for inspection by the public: SECTION 1. Form of Request. Requests for inspection of any identifiable public record, copies of same, or certified excerpts therefrom shall be ^jade i^ writing on forms provided by the City department responsible for the keeping of such record, and shall contain the following information: Name and address of person, corporation, partnership, form or association making such request. 2. Identification of record being requested. 3. Amount of fee or deposit accompanying request per schedule established by the City Council and set forth in Section 4 herein. 4. Date of request and date and time information is required. SECTION 2. Time Periods for Requests. Requests are to be made during regular business hours, and a reasonable period of time to be determined by the department head for handling such requests shall be allowed. SECTION 3. Records Exempt from Inspection. Certain records enumerated in Section 6254 ofthe Government Code shall be exempt from inspection by the public; in addition, business license applications and any other records for which is can be demonstrated by the officer who has custody that the public interest served by not RM making such record public clearly outweighs the public interest served by disclosure of the record. The City Manager shall review and approve or reverse such denials. SECTION 4. Fee Schedule. The schedule of fees and/or deposits is hereby established as follows: Copies of public records (one copy of current $0.20 per page agenda packet item provided free of charge) Fair Political Practices Commission Filings $0.10 per page Fax copies of public records Up to 10 pages will be faxed; longer documents will be mailed City Council, Agency, District or Commission $20.00 per year Agendas (half price 7/1 through 12/31) City Council, Agency, District or Commission $60.00 per year Minutes (half price 7/1 through 12/31) Municipal Code Volume and Binder $195.00 Municipal Code Supplement Service $35.00 per year Title 9, Land Use (includes I" year supplement $35.00 service) Title 9, Supplement Service $8.00 per year Title 8, Building Regulations (includes I" year $12.00 supplement service) Title 8, Supplement Service $5.00 per year General Plan Text $15.00 Equestrian/Hiking/Biking Trail Map $2.00 $1.70 for non- profit organizations and retail sales of 50 or more Zoning or General Plan Map $5.00 Architectural Design Guidelines and Hillside $13.00 Development Guidelines Fiscal Budget $25.00 Comprehensive Annual Financial Report (CAFR) $25.00 Copies of audio meeting tapes No charge; 90 min. audio tapes provided by requester -2- SECTION 5. Waiver of Fees. The above fees may be waived at the discretion of the Department Head concerned when it is clear that the general public and/or the City will benefit by providing the service at no cost. as follows: (a) Examples of the types of service for which the above fees may be waived are (1) Requests from City Officials, Board Members, etc. (2) Requests from other public agencies, especially in cases of cooperative exchange of information. (3) Requests from non-profit or charitable groups such as the Chamber of Commerce, Boy Scouts, etc. (4) Requests from individuals or firms directly concerned with pending actions of the City Council, which require their attendance at a public hearing, or when legal notice is required. (b) Decisions on questionable items shall be made by the City Manager. SECTION 6. Appeals. Appeals to the City Council may be filed with the City Clerk by those who desire to protest these charges or request waivers. SECTION 7. Repealer. Resolution No. 90-11-20-4 is hereby repealed.
