Resolution Number 98-6-2-11169 RESOLUTION NO. 98-6-2-11 APPROVING GENERAL PLAN AMENDMENT 95-3 (RESCO DEVELOPMENT/SHURGARD STORAGE/SCHAUWECKER) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO,CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 95-3 TO CHANGE THE GENERAL PLAN DESIGNATION OF THE PROJECT SITE FROM PUBLIC INSTITUTIONAL TO SPECIAL STUDY FOR PROEPRTY LOCATED AT 32731 SAN JUAN CREEK ROAD (RESCO DEVELOPMENT/SHURGARD STORAGE/SCHAUWECKER) WHEREAS, the applicants, Doug Simpson, Resco Development Company, 1400 North Bristol Street, Suite 150, Newport Beach, CA 92660, and Thomas Schauwecker, 31592 Paseo Don Jose, San Juan Capistrano, CA 92675, have submitted a request for a General Plan Amendment to amend the General Plan Land Use Map and the Land Use Element text for development of a self - storage facility at 32731 San Juan Creek Road; and WHEREAS, this proposal has been reviewed in accordance with the California Environmental Quality Act, (CEQA, 1970). On January 6, 1998, the City's Environmental Administrator reviewed this proposal and determined that it qualifies for issuance of a mitigated negative declaration, and all mitigation measures are included as conditions of approval in this resolution; and WHEREAS, on January 27, 1998 the Planning Commission held a duly noticed public hearing to consider testimony on the mitigated negative declaration, General Plan Amendment 95-03, Rezone 96-05 and Architectural Control 96-09 and forwarded a recommendation of approval to the City Council; and WHEREAS, on February 17, 1998 the City Council held a duly noticed public hearing to consider testimony on the mitigated negative declaration and General Plan Amendment 95-03, Rezone 96-05 and Architectural Control 96-09; and, WHEREAS, the City Council conducted a public meeting on May 19, 1998 to reconsider the merits of the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the City Council ofthe City of San Juan Capistrano does hereby find that: 1. The proposed General Plan Amendment would result in development of a "self -storage facility," a relatively low intensity use which would result in essentially no noise impacts and minimal night lighting impacts on surrounding properties, and would generate an insignificant (2.9%) increase in traffic along San Juan Creek Road. 170 2. The proposed General Plan Amendment would result in development of a "self -storage facility," a use appropriate to the existing General Plan "Noise Impact Area" designation of the property and adjoining areas. 3. The proposed General Plan Amendment would establish a land use which is compatible with the adjacent land uses, including the senior housing facility and veterinarian clinic. BE IT FURTHER RESOLVED, that the City Council approves General Plan Amendment 95-03, amending the General Plan Designation ofa 2.435 -acre site located at 32731 San Juan Creek Road, from Public Institutional to Special Study, and adding the text contained in "Exhibit All to the General Plan Land Use Element, allowing develoment of a "self -storage facility." Designation as a "Special Study" area is restricted to establishing a self storage facility designed and located consistent with Zone Change Application 96-05 and Architectural Control Application 96-09. In considering this General Plan Amendment, the City Council has compared the impacts of the uses permitted under the previous "Public and Institutional" designation with the impacts which would result from a self storage facility. The City Council determined that a "self storage facility" would have less impact on the surrounding area than the uses permitted under "Public and Institutional" designation in terms of noise, traffic, lighting, and dust and odor generation. Additionally, because the subject property is located within a General Plan -designated "Noise Impact Area" and the proposed designation would not involve any noise sensitive receptors (e.g. school children or other users who require low noise levels), the proposed "self storage facility" use is especially well-suited to this location.
