Resolution Number 98-6-2-10163 RESOLUTION NO. 98-6-2-10 CONFIRMING A MITIGATED NEGATIVE DECLARATION RESCO DEVELOPMENT/SHURGARD STORAGE/SCHAUWECKER) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONFIRMING A MITIGATED NEGATIVE DECLARATION FOR GENERAL PLAN AMENDMENT 95-3, REZONE 96-5 AND ARCHITECTURAL CONTROL 96-9, FOR DEVELOPMENT OF A SELF -STORAGE FACILITY AT 32731 SAN JUAN CREEK ROAD (RESCO DEVELOPMENT/SHURGARD STORAGE/SCHAUWECKER) WHEREAS, the applicants, Doug Simpson, Resco Development Company, 1400 North Bristol Street, Suite 150, Newport Beach, CA 92660, and Thomas Schauwecker, 31592 Paseo Don Jose, San Juan Capistrano, CA 92675, have submitted a request for a approval of General Plan Amendment, Rezone and Architectural Control application to allowthe construction of self -storage facility at 32731 San Juan Creek Road; and WHEREAS, this proposal has been reviewed in accordance with the California Environmental Quality Act, (CEQA, 1970). On January 6, 1998, the City's Environmental Administrator reviewed this proposal and determined that it qualifies for issuance of a mitigated negative declaration, and all mitigation measures are included in this draft resolution ; and WHEREAS, on January 27, 1998 the Planning Commission held a duly noticed public hearing to consider testimony on the mitigated negative declaration and forwarded a recommendation of approval to the City Council; and, WHEREAS, on February 17, 1998 the City Council held a duly noticed public hearing to consider testimony on the mitigated negative declaration, General Plan Amendment and Rezone applications; and WHEREAS, on May 19, 1998, the City Council conducted a public meeting to reconsider the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the City Council ofthe City of San Juan Capistrano does hereby find that: 1. The proposed mitigated negative declaration is consistent with all applicable provisions of the California Environmental Quality Act (1970) as amended; and, 2. The proposed mitigated negative declaration is consistent with all applicable provisions of the City's Environmental Review Guidelines for local implementation of the provisions of the California Environmental Quality Act; and, 164 3. The mitigation measures contained herein, as issued by the City's Environmental Administrator, will reduce potentially significant environmental impacts to a level of insignificance, and the Environmental Administrator has determined that the project would not result in a significant, adverse impact to the environment. BE IT FURTHER RESOLVED, that the City Council confirms a mitigated negative declaration for General Plan Amendment 95-03, Rezone 96-05 and Architectural Control 96-09 to allow development of a self -storage facility proposed for a 2.435 -acre site located at 32731 San Juan Creek Road subject to the following mitigation measures: WATER: Mitigation measure #1: The proposed stormwater drainage system design shall comply with the City's adopted "stormwater management regulations and policies" subject to review and approval by the City Engineer or his designee. Mitigation measure #2: The stormwater outfall to San Juan Creek shall be designed and located so that it does not result in stream channel erosion and does not create additional flooding problems to the site. LIGHT AND GLARE: Mitigation measure #3: Prior to architectural control approval, the project proponent shall prepare and submit a lighting plan and photometric analysis of the lighting plan which adequately demonstrates that the location and intensity of proposed lighting will be consistent with Section 9- 3.614, Lighting of the Land Use Code to the satisfaction of the Planning Commission. Mitigation measure #4: All exterior lighting fixtures shall be provided with shielding and cutoffs and situated so that direct light does not encroach on adjoining properties, in particular the Chateau San Juan senior housing complex to the east. LAND USE: Mitigation measure #5: In conjunction with architectural control review and approval, the project proponent shall create an edge treatment design along the easterly property boundary which addresses aesthetic, noise, and light and glare impacts. Mitigation measure #6: The landscape plan will provide suitable concepts to visually buffer the easterly boundary. All lighting shall be mounted within and below the perimeter wall/building of the proposed project. AESTHETICS: Mitigation measure #7: Building massing for the proposed project, will be compatible with that established by the Chateau San Juan senior housing complex, as determined by the Planning -2- Commission. The perimeter building shall be limited to a one-story building height and shall include architectural details and landscaping as determined by the Planning Commission ARCHEOLOGICAL/HISTORICAL: Mitigation measure #9: Prior to issuance of a grading permit, the applicant will retain the services of a SOPA (Society of Professional Archaeologists) -certified archeologist who will monitor all grading and excavation for potential impacts on cultural resources including archeological, paleontological, and historic resources. The applicant will provide an executed contract for services with a SOPA-certified archeologist including a scope -of -work which provides for comprehensive monitoring; a contingency for assessment, recovery, and/or evaluation; and the preparation of a technical memoranda or report. In the event cultural resources are encountered during grading, the monitor may cease grading operations, consistent with City Council policy, to allow for the assessment, recovery, and/or evaluation of any cultural resources.
