Resolution Number 04-10-05-04RESOLUTION NO. 04-10-05-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING A SPECIAL EVENT PERMIT AT THE PARKING LOT LOCATED ON THE NORTHWEST CORNER OF YORBA STREET AND EL CAMINO REAL FOR THE SWALLOWS INN 50TH ANNIVERSARY CELEBRATION WHEREAS, the applicant, Swallows Inn, has requested approval to conduct a 50`h Anniversary Celebration at the parking lot to the rear of the Swallows Inn ("the Love lot"), generally located west of EI Camino Real, north of Yorba Street, in conjunction with Probation Community Action Association; and, WHEREAS, the City Council considered the request at a public meeting on October 5, 2004. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve the special event for the Swallows Inn 50`h Anniversary Celebration, subject to the following conditions: 1. The applicant must obtain all necessary City permits and required documentation for the event, including a special activities permit and site plan, a facility use permit, a City Manager's alcohol permit, a City business license for all vendors, and applicable insurance coverage. 2. The applicant must submit to the City not less than 24 hours prior to the event copies of other permits and documentation required by outside agencies, including Orange County Health Department, Orange County Fire Department, State Board of Equalization, State of California Alcohol permit, CR&R recycling requirements, Orange County Sheriffs Department approvals for security. 3. The applicant must mail written notifications to all businesses within 1000 feet of the proposed event a minimum of 10 days prior to the event. 4. Within 10 days following the event, the applicant must submit written verification and documentation to the City indicating the gross funds generated from the event and the amount of net profit donated to Probation Community Action Association and/or any other local community non-profit organizations to demonstrate community benefit derived from the event. The three-hour parking restriction limit shall be maintained for all parking lots and parking stalls on the day of the proposed event. 6. Outdoor alcohol sales for the event shall be discontinued at 5:00 p.m. All amplified music must cease by no later than 5:30 p.m. All noise shall comply with the City's noise standards pursuant to the City's Municipal Code. The event shall close to the public no later than 7:00 p.m. 10. The applicant shall provide $2 million in insurance coverage for general liability and alcohol liability naming the City of San Juan Capistrano and the Community Redevelopment Agency as certificate holders. 11. Any traffic control needed for the event shall be in accordance with the plan approved by the City's Traffic Engineer. The applicant shall be responsible for picking up the traffic control signs at the City's maintenance yard 24 hours prior to the event, installing the traffic control signs per the approved plan prior to opening the event, removing all the traffic control barricades and signs immediately following the event, and returning the City's property by noon on Monday following the event. 12. The applicant shall be responsible for picking up and returning any other City equipment necessary for the event by the schedule identified in item 11. 13. The applicant shall deposit $500 for a compliance and security deposit. The site and streets must be cleaned to their original condition by no later than Monday following the event. Any City costs incurred as a result of the event will be deducted from the deposit. If the costs exceed the deposit amount, the applicant shall be responsible for submitting additional funds to the City to pay for the costs. 14. The applicant shall deposit funds with the City to pay for the Orange County Sheriffs Deputy (cost to be determined by Lt. Davis) a minimum of 24 hours prior to the event. Security for the event shall be provided by the applicant as determined by Lt. Davis. 15. Portable self-contained restrooms shall be provided at a location approved by the City. Portable restrooms shall not be located in the street areas. 16. For all future special activities permit applications, the applicant shall submit a complete application and required documentation to the City a minimum of 60 days prior to the event.
