Resolution Number 99-7-20-7295 RESOLUTION NO. 99-7-20-7 APPROVING APPEAL - ARCHITECTURAL CONTROL MODIFICATION 79-7 (PLAZA DEL RIO) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, UPHOLDING AN APPEAL OF THE PLANNING COMMISSION'S DENIAL OF ARCHITECTURAL CONTROL MODIFICATION 79-7, A PROPOSED RENOVATION OF THE SHOPPING CENTER AT 32291-32401 CAMINO CAPISTRANO (PLAZA DEL RIO) WHEREAS, Donahue Schriber, 3501 Jamboree, Suite 300, Newport Beach, California 92660, and Graphic Solutions, 1750 Kettner Boulevard, San Diego, California 92101, have requested approval of Architectural Control Modification 79-7, to allow renovation of the Plaza del Rio shopping center to include modifications to landscaping, signs, roof elements, lighting and colors for the center; and, WHEREAS, the proposed project has been processed pursuant to Section 9-2.301, Development Review, of the Municipal Code; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to -- Section 15061 ofthe California Environmental Quality Act (CEQA) and issued a Class 1 categorical exemption and caused a Notice of Exemption to be posted pursuant to Section 15062 of the CEQA Guidelines; and, WHEREAS, the Planning Commission has considered the Environmental Review Board's determination pursuant to Section 15074 of the California Environmental Quality Act; and, WHEREAS, the Planning Commission conducted a duly -noticed public meeting on June 8, 1999, pursuant to Section 9-2.313 ofthe Municipal Code to consider public testimony on the proposed project and denied the project without prejudice; and, WHEREAS, the applicant has submitted an appeal of the Planning Commission's denial to the City Council; and, WHEREAS, the City Council considered the appeal at its meeting of July 20, 1999. NOW, THEREFORE, BE IT RESOLVED, that the City Council ofthe City of San Juan Capistrano does hereby make the following findings: 1. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Community Design Element, because the design promotes the small, rural, village -like atmosphere of San Juan Capistrano in both the design theme and scale of the project; and, -1- 296 2. The proposed project complies with all applicable provisions of the Land Use Code subject to the mitigation measures and conditions of approval contained in this resolution. The City Council has made the following findings for an exception to the lighting standards, Section 9-3.614: 1. That there are special physical circumstances in areas surrounding the property which justify granting the exception. project. There are special physical circumstances in that the property is bordered by commercial property on two sides and by San Juan Creek and the railroad tracks on the other two sides. There are no residential properties adjoining the property on any side. That the intent of the requirement is being met in the design of the total The intent of the requirement is being met in the design of the total project in that the 20 -foot poles with cut-off luminaires will be within acceptable tolerances of the lighting standards, both for minimum/maximum foot-candle on the pavement and for uniformity ratios. 3. That there is little potential for the exception to create a negative impact on surrounding areas. The exception has little potential to create a negative impact on surrounding areas. It has been demonstrated by the applicant that the type of fixtures being used will not spill out to adjoining properties and glare will be minimized by their use. Also, there are no residential properties and no commercial properties that remain open at night in this area. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby confirm issuance of a categorical exemption and upholds the appeal of the applicant subject to the following conditions of approval: 1. The applicant shall revise the project lighting design to include the use of 20 - foot -tall light poles rather than the proposed 22 -foot -tall poles. 2. The applicant shall revise the design of the monument sign to incorporate external illumination for the sign rather than internal illumination, in conformance with the Municipal Code. 3. Trellis Design. The trellis design dated June 4, 1999, for the lower -level area separating buildings "C" and "D" showing a horizontal design shall be modified. That portion of the trellis that is higher than the remaining portion of this feature shall incorporate an angled roof pitch consistent with the lower roof element of the adjacent clay tile roof. Said final design to be reviewed and approved by the Planning Director. -2- 297 4. Internal Circulation Design at Main Entry. The City Engineer shall evaluate the possible closure of the northerly aisle intersection with the main entry. The purpose of this study is to determine if placement of a landscape area to reduce vehicular turning movements at this internal intersection will create a more efficient entry/exit movement of vehicles at the signalized intersection. If it is determined that installation of such a barrier will not result in significant vehicular movement impacts on other portions of the project, the applicant shall install a landscape planter area, closing said entry. If said determination is found that significant impacts would occur, then the applicant will be required to install a stop sign at the intersection to preclude free left turns from said drive aisle subject to review and approval of the City Engineer.
