RESOLUTION NO. 99-2-16-2
ADOPTING REVISED DEVELOPMENT APPLICATION
AND DEPOSIT FEE SCHEDULE
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, ADOPTING A REVISED DEVELOPMENT
APPLICATION AND DEPOSIT RESOLUTION BY TITLE 9, CHAPTER 2,
ARTICLE 3, SECTION 9-2.316 OF THE MUNICIPAL CODE AND REPEALING
RESOLUTIONS NO. 91-7-2-4, AND 93-1-5-3
WHEREAS, the Municipal Code states that the City Council may from time to time
establish the amount of fees authorized by the provisions of Section 9-2.316 of the Municipal Code;
and,
WHEREAS, the current schedule for development application fees and deposits was
last established by City Council Resolution No. 93-1-5-3, adopted on January 5, 1993; and,
WHEREAS, during the intervening six years, the City Council has adopted a number
of amendments to the Municipal Code that have modified and streamlined the development review
process in order to reduce the time and costs of processing development applications; and,
WHEREAS, the Planning Services Department has reviewed the current fee schedule
and determined that it is appropriate to modify the fixed fee schedule to reflect efficiencies made to
the review procedures to reduce the cost of processing certain development applications and has also
reviewed the level of initial deposit levels for development applications that are subject to the
Development Deposit system and determined that said initial deposit schedule should be adjusted;
and,
WHEREAS, the City Council recently approved the adoption of Classification and
Compensation Schedule for employees of the organization which included title changes that need
to be reflected in the Development Application Fee and Deposit schedule to be internally consistent;
and,
WHEREAS, the City Council has conducted a duly -noticed public hearing to receive
public testimony and has hereby considered the revised fee and deposit schedule at its regular
meeting of February 16, 1999, after having provided additional notice as required by law to the
Orange County Chapter of the Building Industry Association as requested by prior letter.
NOW, THEREFORE, BE IT RESOLVED, that the City Council ofthe City of San
Juan Capistrano does hereby modify the Development Application Fee and Deposit Schedule in its
entirety to read as follows:

DEVELOPMENT APPLICATION FEES AND DEPOSITS
The fees and deposits listed below are required to be paid prior to any processing of a development
application. The initial deposits are intended to provide funding for processing of an application.
If the deposited funds are depleted during the processing of the application, additional funds will be
required by the City. If the requested funds are not received, processing of the development
application maybe delayed or interrupted pending receipt of the funds. Any unused funds at project
completion will be reimbursed to the applicant.
Developer Deposit Applications
1. Schedule of Hourly Rates (City Staffl - The following staff positions shall charge actual
hours expended on a project which has been assigned a developer deposit account:
Principal Planner
Building Official
Senior Engineering Technician
Senior Planner
Senior Engineer
Associate Civil Engineer
Assistant Planner
Senior Civil Engineer
Engineering Assistant
Associate Planner
Engineering Technician
Community Services Supervisor
Planning Technician
Traffic Engineer
Management Analyst I (Planning)
Hourly rates of City staff positions shall be determined from the current salary schedule
adopted by City Council resolution each fiscal year. Overhead costs shall be added to the staffs
hourly rate. Overhead shall be calculated and published bi-annually (January 15 and July 15) by the
Director of Administrative Services in accordance with the Office of Management and Budget
Circular A-87 (Cost Principles for State and Local Governments).
2. Schedule of Hourly Rates (Outside Consultants) - Consultants' actual cost shall be charged
against the developer deposit account. The consultant contracts are determined by the Planning
Director and agreement executed by the City Manager. A ten percent (10%) administration fee is
charged against the applicable developer deposit account for any consultant invoices processed on
a developer deposit account applications.
3. Developer Deposit Applications (Initial Deposit) - The following applications are subject to
processing under the provisions of the Developer Deposit System. The Initial Deposit for each
application is set forth below. The Planning Director may adjust the initial deposit for a given
project applicant upon a determination that the initial deposit will be substantially above or below
the amount estimated to complete the project review.

DIGITAL SUBMISSION FEES
The following fees shall be charged in addition to the normal plan check fees if the development
applicant does not have the capability to provide improvements plans that are not submitted in a
digital format. All development improvement plans that are submitted in a digital format in

accordance with the adopted digital Submission Standards will not be subject to this fee. The
applicable fee is as follows:
