CERTIFICATION OF NEGATIVE DECLARATION - CAPISTRANO
VALLEY BOYS AND GIRLS CLUB (SITE PLAN REVIEW 98-2)_
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, CERTIFYING ISSUANCE OF A NEGATIVE
DECLARATION ON AN AMENDMENT TO THE COMMUNITY CENTER
CONCEPT PLAN APPROVALS TO ALLOW AN EXPANDED YOUTH
FACILITY TO BE INTEGRATED WITH THE COMMUNITY CENTER, 25925
CAMINO DEL AVION (CAPISTRANO VALLEY BOYS AND GIRLS CLUB)
WHEREAS, at its meeting of April 15, 1997, the City Council considered a proposal
from the Capistrano Valley Boys and Girls Club to expand the planned youth services facilities at
the City's Community Center and to enter into a joint agreement for funding and constructing and
operating the facility; and,
WHEREAS, at its meeting of April 15, 1997, the City Council requested that the
Capistrano Valley Boys and Girls Club provide additional information before further considering
the merits of the proposal; and,
WHEREAS, the Capistrano Valley Boys and Girls Club has submitted the requested
information, which was considered by the City Council at its meeting of May 19, 1998; and,
WHEREAS, at its meeting of May 19, 1998, the City Council adopted a public
participation program for reviewing the formal proposal by the Capistrano Valley Boys and Girls
Club and the amendment to the adopted Community Center Concept Plan; and,
WHEREAS, the City conducted a duly -noticed community workshop on June 11,
1998, for the purpose of introducing the formal proposal from the Capistrano Valley Boys and Girls
Club to the community; and,
WHEREAS, the Parks, Recreation and Equestrian Commission conducted a duly -
noticed public hearing on the proposal on June 29, 1998, and forwarded a recommendation of
approval to the City Council; and,
WHEREAS, the Environmental Administrator has reviewed the project pursuant to
Section 15061 of the California Environmental Quality Act (CEQA) and has issued a negative
declaration and caused a Notice of Negative Declaration to be posted pursuant to the City's
Environmental Review Guidelines, and any applicable mitigation measures have been included
herein as conditions of approval, and has otherwise complied with all applicable provisions of the
California Environmental Quality Act; and,
WHEREAS, the Planning Commission considered the Environmental Review
Board's determination pursuant to Section 15074 of the California Environmental Quality Act; and,
WHEREAS, the Planning Commission conducted a duly -noticed public hearing on
July 14, 1998 and on July 28, 1998, pursuant to Section 9-2.313 of the Municipal Code to consider

public testimony on the proposed amendment to the adopted Community Center Concept Plan and
forwarded the amendment to the City Council recommending certification of the Negative
Declaration and approval of the amendment, subject to the conditions listed in this resolution; and,
WHEREAS, on August 18, 1998, the City Council conducted a duly -noticed public
hearing to consider testimony from the public in favor of or in opposition to the proposed
amendment to the adopted Community Center Concept Plan and approved the proposed amendment;
and,
WHEREAS, the Congress of the United States, as part of the adoption of funding
authorization for the Department of Housing and Urban Development, did set aside $500,000 to
assist in funding the construction of the youth services portion of the City's Community Center to
be operated by the Capistrano Valley Boys and Girls Club; and,
WHEREAS, the application for a grant for construction purposes can be considered
a project under the provisions of the California Environmental Quality Act in that said action will
result in a physical project being implemented; and,
WHEREAS, the City's Environmental Administrator has reviewed previous
environmental studies conducted for the site and has determined that the construction of the youth
services portion of the Community Center as funded by the United States Government will not result
in a significant impact upon the environment and has accordingly required the issuance of a Negative
Declaration, which has been posted in accordance with State regulations and at designated places
consistent with adopted City Council Policy for the purpose of providing the public an opportunity
to review the Initial Study prepared for the overall project as contained in previous actions associated
with Site Plan Review 98-2 (City of San Juan Capistrano/Capistrano Valley Boys and Girls Club);
and,
WHEREAS, a duly -noticed public hearing was conducted on January 5, 1999 to
receive testimony on the adequacy of the Negative Declaration by the City Council.
NOW, THEREFORE, BE IT RESOLVED, that the City Council ofthe City of San
Juan Capistrano does hereby find and certify that the Negative Declaration prepared for Site Plan
Review 98-2, and associated agreements and funding of said project, will not result in a significant
impact upon the environment.
