RESOLUTION NO. 00-5-31-6
APPROVING REVISED PERIMETER WALL DESIGN - VESTING
TENTATIVE TRACT MAP 15998 (VILLAGE ALIPAZ)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING A REVISED PERIMETER
WALL DESIGN FOR VILLAGE ALIPAZ - VESTING TENTATIVE TRACT
MAP 15998 (VILLAGE ALIPAZ LLC)
WHEREAS, the applicant, Village Alipaz, LLC, 19700 Fairchild Road, Suite
120, Irvine, California 92612, has submitted revised perimeter wall designs in accordance
with Condition No. 2 of City Council Resolution No. 00-4-18-2; and,
WHEREAS, this proposal has been reviewed in accordance with the
California Environmental Quality Act. On October 5, 1999, the Environmental
Administrator issued a mitigated negative declaration, which covered phases one and two
of the Village Alipaz project. On November 16, 1999, the City Council certified the
mitigated negative declaration; and,
WHEREAS, on April 18, 2000, the City Council held a duly -noticed public
- hearing to consider testimony both in favor of, and in opposition to, Vesting Tentative Tract
Map 15998, and adopted City Council Resolution No. 00-4-18-2, conditionally approving
the proposed vesting tentative tract map; and,
WHEREAS, Coldition Number 2 of Resolution No. 00-4-18-2 required a
specific design for the combination retaining/privacy wall along the south elevation of the
project site, or additional consideration of an alternate design by the City Council.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby find that:
1. The proposed wall design locates the rear yard wooden fence, the
landscape planter and the retaining wall entirely within the project boundaries, and as a
result, the applicant would not require permission from any adjacent property owner or
easement holder.
2. The proposed wall will have a taller retaining wall component than the
approved wall, however, because the proposed wall does not encroach into the access
easement it will be located fifteen feet from the existing coaches, instead of five feet.
Additionally, the proposed wall provides adequate room for planting vines which would
cover the rear -yard fences, as well as shrubs and ground -cover which would block the
rear -yard fences and cascade down the retaining wall, visually softening the wall.

BE IT FURTHER RESOLVED, thatthe City Council does hereby approve the
applicant's proposed wall design, or alternatively, the wall design as approved on April 18,
2000, subject to the following condition:
1. Prior to issuance of a building permit for the proposed wall, the
applicant shall submit a revised wall plan which incorporates a rounded transition into the
west end of the wall, where the wall connects with the streetscape on Alipaz Street. This
design shall be reviewed and approved by the Planning Commission as part of the final
approval of the landscape plans.
