Resolution Number 00-5-31-4301 RESOLUTION NO. 00-5-31-4 6i�] 1�]AiI�[41010]�&is],IByAd101Zto] awat4:L.W4ZC9L*� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, SUPPORTING THE CONSOLIDATION OF THE ALISO WATER MANAGEMENT AGENCY, THE SOUTH EAST REGIONAL RECLAMATION AUTHORITY AND THE SOUTH ORANGE COUNTY RECLAMATION AUTHORITY WHEREAS, the Aliso Water Management Agency (AWMA) is a Joint Powers Authority created in 1972, whose Member Agencies include the City of Laguna Beach, the South Coast Water District, the Moulton Niguel Water District, the Emerald Bay Service District, the EI Toro Water District, and the Los Alisos Water District; and, WHEREAS, AWMA provides regional wastewater treatment, disposal and water reclamation services to its six Member Agencies through various jointly -owned and operated facilities in the Aliso and Laguna Creek Watersheds; and, WHEREAS, the South East Regional Reclamation Authority (SERRA) is a Joint Powers Authority created in 1970, whose Member Agencies include the City of San Juan Capistrano, the City of San Clemente, the South Coast Water District, the Moulton Niguel Water District, and the Santa Margarita Water District; and, WHEREAS, SERRA provides regional wastewater treatment, disposal and water reclamation services to its five Member Agencies through various jointly -owned and operated facilities in the San Juan Creek Watershed; and, WHEREAS, the South Orange County Reclamation Authority (SOCRA) is a Joint Powers Authority created in 1991 whose Member Agencies include the Santa Margarita Water District, the EI Toro Water District, the Trabuco Canyon Water District, the Los Alisos Water District, the Irvine Ranch Water District, the Moulton Niguel Water District, the Capistrano Valley Water District and the South Coast Water District; and, WHEREAS, SOCRA provides regional recycled water planning, permitting and regulatory liaison services to its eight Member Agencies within Regions 8 and 9 of the State Water Resources Control Board; and, WHEREAS, AWMA, SERRA, and SOCRA are each similarly organized into a series of Project Committee activities which provide for capital construction, cooperation and maintenance of facilities or other services which limit financial responsibility and liability only to those Member Agency participants in each Project Committee; and, WHEREAS, AWMA and SERRA have been jointly administered by a single management staff since 1982, and SOCRA since 1991, intended to minimize overhead and provide consistent management along with coordination, cooperation, and operational efficiencies; and, WHEREAS, in an effort to improve efficiency and reduce duplication of effort, the Boards of Directors of AWMA, SERRA and SOCRA have, over a period of years, studied -1- 302 the option of consolidating the Authorities into a single agency serving the wastewater treatment, disposal and water reclamation needs of the South Orange County area; and, WHEREAS, in a recent report to the Boards of AWMA and SERRA, the General Manager of the Agencies once again recommended the consolidation of AWMA, SERRA and SOCRA, an action supported by several past consultant and/or staff organizational analyses; and, WHEREAS, the AWMA/SERRA/SOCRAstaff has provided information regarding the costs and benefits of the proposed consolidation, along with the steps necessary to complete a legal consolidation; and, WHEREAS, at the Joint Meeting on April 6, 2000, the Boards of AWMA and SERRA reviewed the recommendation of staff and requested that the matter be referred to the Member Agencies of AWMA, SERRA and SOCRA for concurrence before proceeding further, recognizing that a consolidation of the three Joint Powers Authorities requires unanimous approval of all the Agencies; and, WHEREAS, this Agency has received a request for an action supporting the consolidation of AWMA, SERRA and SOCRA; and, WHEREAS, this Agency has reviewed all pertinent materials related to this matter at its meeting of May 16, 2000, and now desires to express its support for consolidation. NOW THEREFORE, the City Council of the City of San Juan Capistrano does hereby resolve, determine and order as follows: SECTION 1. That the City Council of the City of San Juan Capistrano supports the legal consolidation of the AWMA, SERRA and SOCRA Joint Powers Authorities, in an effort to improve efficiency and reduce duplication of effort. SECTION 2. That the City Clerk is directed to forward a certified copy of this Resolution to the AWMA, SERRA, and SOCRA Boards of Directors. PASSED, APPROVED AND ADOPTED this 31st day of May, 2000.
