Resolution Number 00-3-21-1209 RESOLUTION NO. 00-3-21-1 APPROVING APPEAL OF PLANNING COMMISSION ACTION - MODIFICATION TO ARCHITECTURAL CONTROL 88-8 (CAPISTRANO HOME CENTER) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPAROVING AN APPEAL OF THE PLANNING COMMISSION'S DENIAL OF A REQUEST FOR APPROVAL OF AN ENTRY ARCHWAY SIGN FOR PROPERTY LOCATED AT 31894 AND 31896 PLAZA DRIVE AND MORE SPECIFICALLY REFERRED TO AS ASSESSOR'S PARCEL NUMBERS 668-451-001 AND 668-214-023 (CAPISTRANO HOME CENTER) WHEREAS, The Nichols Company, 3600 Birch Street, No. 100, Newport Beach, California 92660, has appealed the Planning Commission's February 8, 2000, action to deny without prejudice, an entry archway sign proposed to be located off-site at the entrance to the Capistrano Home Center, which is General Plan -designated 3.1 General Commercial and classified as CG General Commercial on the Official Zoning Map; and, WHEREAS, the proposed project has been processed pursuant to Section 9-2.301, Development Review of the Land Use Code; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act and issued a Class 11 categorical exemption and caused a Notice of Exemption to be posted pursuant to Section 15062 of the California Environmental Quality Act Guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act; and, WHEREAS, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act; and, WHEREAS, the Planning Commission conducted a continued duly -noticed public hearing on February 8, 2000 pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on the proposed project; and, WHEREAS, the City Council conducted a duly -noticed public hearing on March 21, 2000, pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: -1- 210 1. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Community Design Element, because the project will incorporate design factors that maintain an overall continuity between various features of the local environment; and, 2. As conditioned the proposed project is consistent with the findings established by Section 9-2.306 of Title 9, Land Use Code, with respect to the approval of architectural control applications; and, 3. As conditioned the proposed project is consistent with the findings established by Section 9-3.603 of Title 9, Land Use Code, with respect to the approval of sign programs. BE IT FURTHER RESOLVED that the City Council has made the following findings for an exception to the sign standards, Section 9-3.603: 1. There are special physical circumstances in that the property is located in a depression west of the 1-5 freeway, behind an existing retail center, and consisting of exposure only to the freeway. Signs in excess of the Municipal Code standards are crucial in creating a more visible center. 2. The intent of the requirement is being met in the design of the total project in that the signs as conditioned would create a more active center through increased visibility of the center to passing motorists. 3. The exception has little potential to create a negative impact on surrounding areas due to the fact that the situation of the center in a depression would mainly be visible from the southerly 1-5 freeway lanes, and no residential properties reside near the site. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano hereby approves the appeal for a request for approval of an Entry Archway Sign, subject to the following conditions of approval: Conditions of Aooroval 1. Prior to issuance of building permits, the applicant shall provide a maximum clearance height warning sign for the proposed entry archway, subject to review by the Director of Planning, 2. Illumination of the entry archway sign shall be provided by 15mm, 6500 Voltarc white neon tubing, powered by a 30 mili-amp transformer 3. The entry archway sign shall utilize an 18 -inch maximum internally - illuminated letter height, with a total sign copy not to exceed 82 square feet. -2- 211 4. The sign copy shall be modified to reflect a revised project name that identifies the site as a home improvement center. Said sign copy and font shall be subject to review and final approval by the Planning Director. 5. The applicant shall ensure that the Entry Archway Sign's internally illuminated letters are turned off no later than 30 minutes past the last tenant's closing time, and in no instance shall the sign lighting remain on past 10:30 P.M.
