Resolution Number 00-3-7-6195 RESOLUTION NO. 00-3-7-6 APPROVING RESIDENTIAL ALLOCATION SCHEDULE FOR CALENDAR YEARS 2000 THROUGH 2003 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING THE RESIDENTIAL ALLOCATION SCHEDULE FOR CALENDAR YEARS 2000 THROUGH 2003 PURSUANT TO TITLE 9, CHAPTER 7, RESIDENTIAL GROWTH MANAGEMENT PROGRAM WHEREAS, Chapter 7 of Title 9, Land Use Code, adopted by Ordinance No. 398 on February 20, 1980, establishes the City's Growth Management Regulations and regulates the allocation of residential building permits; and, WHEREAS, Section 9-7.09 of the ordinance requires that the City annually establish a Residential Allocation Schedule for residential building permits to be issued for the current year and each of the succeeding three calendar years; and, WHEREAS, the potential environmental impacts of the Residential Growth Management Program were fully disclosed in environmental documents prepared in conjunction with adoption of Ordinance No. 398 in accordance with the California Environmental Quality Act (1970); and, WHEREAS, the Planning Commission has previously considered the environmental determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, WHEREAS, Section 9-2.102 of the San Juan Capistrano Municipal Code requires that the Planning Commission conduct a duly -noticed public hearing and the Commission conducted such a public hearing on January 25, 2000, pursuant to Section 9-3.200 of the Municipal Code to consider testimony on the proposed residential allocations; and, WHEREAS, at its meeting of January 25, 2000, the Planning Commission forwarded a recommendation of approval to the City Council per Exhibit "A," attached; and, WHEREAS, the City Council conducted a duly -noticed public hearing on March 7, 2000, to consider public testimony on the proposed Residential Allocation Schedule. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed 2000-2003 Residential Allocation Schedule set forth in Exhibit "A" provides equitable and appropriate building permit -1- 196 allocations within the numerical limits established by City Council Resolution; and, 2. The proposed 2000-2003 Residential Allocation Schedule is consistent with the policies and objectives of the San Juan Capistrano General Plan; and, 3. The 2000-2003 Residential Allocation Schedule provides for reasonable build -out schedules for those projects eligible for building permit allocations. 4. Those projects that have been approved for allocation consideration remain consistent with the goals and policies of the recently -adopted General Plan. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby approve the Residential Allocation Schedule as depicted in Exhibit "A" forthe Calendar Years 2000 through 2003 in accordance with the requirements of Title 9, Chapter 7 of the Municipal Code.
