RESOLUTION NO. 00-2-1-8
APPROVAL OF MODIFICATION TO HEIGHT MATRIX -
TRACT 10103, LOT 29 (BRUM)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING AN EXCEPTION TO THE
CONSTRAINTS MATRIX FOR TRACT 10103, ALLOWING THE
APPLICANT TO EXCEED THE MAXIMUM HEIGHT FOR LOT 29 BY 7
FEET ON A 2.53 -ACRE PARCEL LOCATED AT 27171 HIGHLAND DRIVE
AND MORE PRECISELY REFERRED TO AS ASSESSOR'S PARCEL
NUMBER 650-511-03 (BRUM)
WHEREAS, the applicants, Roger and Debbie Brum, 15 Barcelona, Irvine,
California 92614, have requested approval of a modification to the Constraints Matrix for
Tract 10103 to allow a residence to be built to a height in excess of that allowed by the
Constraints Matrix, such that it will not visually encroach upon a designated General Plan
ridgeline; and,
WHEREAS, the proposed project has been processed pursuant to Section
9-2.301, Development Review, of the Land Use Code; and,
WHEREAS, the applicant has prepared a visual analysis that demonstrates
that the proposed residence with the modification to the height matrix will not visually
encroach upon the designated ridgelines; and,
WHEREAS, the Environmental Administrator has reviewed the project
pursuant to Section 15061 of the California Environmental quality Act and issued a Class
5 categorical exemption and caused a Notice of Exemption to be posted pursuant to
Section 15062 of the California Environmental Quality Act Guidelines and has otherwise
complied with all applicable provisions of the California Environmental Quality Act; and,
WHEREAS, the City Council conducted a duly noticed public hearing on
February 1, 2000, pursuant to Section 9-2.313 of the Municipal Code to consider testimony
on the proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby make the following findings:
1. The proposed project is consistent with the policies and objectives of
the San Juan Capistrano General plan as it relates to prohibiting a visual encroachment
on a ridgeline; and,
2. The proposed project complies with all applicable provisions of the
Land Use Code subject to the condition cited by this resolution.

BE IT FURTHER RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby approve the project subject to the following:
1. Plans submitted for plan check shall be in substantial conformance to
the plans reviewed for this approval and shall not exceed a maximum building height of
537 feet above mean sea level.
