Resolution Number 01-03-06-4333 RESOLUTION NO. 01-03-06-4 OPPOSING SENATE BILL 116 (KUEHL). RELATING TO CONSTRUCTION OF PUBLIC ROADS IN OR THROUGH THE JURISDICTION OF THE STATE DEPARTMENT OF PARKS AND RECREATION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, OPPOSING SENATE BILL 116 (KUEHL), RELATING TO CONSTRUCTION OF PUBLIC ROADS THAT SIGNIFICANTLY INCREASE VEHICULAR TRAFFIC CAPACITY IN OR THROUGH THE JURISDICTION OF THE STATE DEPARTMENT OF PARKS AND RECREATION WHEREAS, Senate Bill 116 would prohibit a State or local agency from constructing, or approving the construction of, any public road, or from making an improvement to an existing road that substantially increases vehicular traffic capacity in or through any property under the jurisdiction of the Department of Parks and Recreation; and, WHEREAS, Senate Bill 116 is aimed at taking local land use planning authority away from elected officials and transportation agencies in local jurisdictions, and will have a significant impact on the extension of the Foothill South Transportation Corridor; and, WHEREAS, the extension of the Foothill South Transportation Corridor is necessaryto address future traffic deficiencies on both the 1-5 and the arterial network, and not addressing these issues will have a severe impact on traffic planning within the City of San Juan Capistrano; and, WHEREAS, in 1991 the City of San Juan Capistrano voted to select the Modified C (generally the CP) alignment as the locally preferred alternative, with ongoing planning efforts reflecting this decision, and the City Council believes Senate Bill 116 would undermine their authority to efficiently move forward with this planning; and, WHEREAS, if the CP alignment is selected, the Transportation Corridor Agencies will compensate for all impacts to San Onofre State Beach Park through a comprehensive mitigation program which will be similar to those of the Eastern Transportation Corridor and the San Joaquin Hills Transportation Corridor, which feature state-of-the-art technology in habitat revegetation, scientific study, habitat conservation/management and endangered species protection. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano hereby opposes Senate Bill 116 and urges the members of the -1- 334 Senate Committee on Natural Resources and Wildlife to consider the impacts of Senate Bill 116 on local jurisdictions and to take a stand of opposition.
