Resolution Number 01-03-06-3329 RESOLUTION NO. 01-03-06-3 APPROVING CONSTRUCTION OF A SIDEWALK ON LA ZANJA STREET BETWEEN CAMINO CAPISTRANO AND EL CAMINO REAL A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CERTIFYING A NEGATIVE DECLARATION AND APPROVING A PROPOSAL TO COMPLETE THE CURB, GUTTER AND SIDEWALK ON THE SOUTH SIDE OF LA ZANJA STREET FROM CAMINO CAPISTRANO TO EL CAMINO REAL (CIP NO. 117) WHEREAS, the City of San Juan Capistrano proposes to complete the curb, gutter and sidewalk on the south side of La Zanja Street from Camino Capistrano to EI Camino Real; and, WHEREAS, this proposal has been reviewed in accordance with the California Environmental Quality Act, 1970. On August 15, 2000, the Environmental Administrator issued a mitigated negative declaration. All mitigation measures have been included as conditions of approval in this resolution; and, WHEREAS, at its meeting of November 14, 2000, the Planning Commission conducted a public meeting to consider public testimony on the proposed project and forwarded a recommendation of conditional approval to the City Council; and, WHEREAS, at its meeting of March 6, 2001, the City Council conducted a public meeting to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find: 1. The Circulation Element of the General Plan includes neighborhood traffic safety as a goal. specifically, the General Plan recommends that a safe network of pedestrian trails and sidewalks should be in place to encourage non -automotive transportation. The proposed sidewalk will provide a safe pedestrian walkway, separate from the street, thus increasing public safety in this neighborhood. BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby certify a negative declaration and approve the project subject to the following mitigation measure: Mitigation Measure Prior to issuance of a grading permit, the applicant shall retain the services of a Society of Professional Archeologists -certified archeologist who shall monitor all -1- 330 grading and excavation for potential impacts on cultural resources, including archeological, _ paleontological and historic resources. The applicant shall provide an executed contract for services with a Society of Professional Archeologists -certified archeologist, including a scope of work which provides for comprehensive monitoring; a contingency for assessment, recovery, and/or evaluation; and, the preparation of a technical memoranda or report. In the event cultural resources are encountered during grading, the monitor may cease grading operations, consistent with City Council policy, to allow for the assessment, recovery, and/or evaluation of an cultural resources.
