CONFIRMING NEGATIVE DECLARATION - MOBILEHOME PARK CONVERSIONS
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO,CALIFORNIA, CONFIRMING A NEGATIVE DECLARATION
FOR ADOPTION OF AN AMENDMENT TO MUNICIPAL CODE SECTION
9-2.319 RELATING TO THE REGULATION OF PROPOSED MOBILEHOME
PARK CONVERSIONS, CLOSURES, AND CESSATION OF USE
WHEREAS, the applicant, City of San Juan Capistrano, 32400 Paseo
Adelanto, San Juan Capistrano, California 92675, has initiated preparation of a land use
coda amendment to Title 9, Section 9-2.319, of the Land Use Code adding rules and
regulations governing the conversion, closure, or cessation of use of any mobile home park
within the City limits; and
WHEREAS, this proposed code amendment has been reviewed in
accordance with the California Environmental Quality Act, (CEQA, 1970). On
September 12, 2000, the City's Environmental Administrator reviewed this proposal, found
thatthe proposed code amendmentwould not result in potentially significant environmental
impacts, and determined that it qualifies for issuance of a negative declaration; and
WHEREAS, on September 12, 2000, the Environmental Administrator also
determined that the proposed code amendment does not affect natural habitat areas
and/or protected animal or plant species and was exempt from the Department of Fish and
Game Code pursuant to Section 7.11.4(d) of the California Fish and Game Code; and
WHEREAS, the Negative Declaration was posted at City Hall, the San Juan
Capistrano Public Library, and the San Juan Capistrano Community Center on
September 14, 2000 through October 4, 2000, and no public comments on the Negative
Declaration were received by the City's Planning Department during the comment period;
and
WHEREAS, the Planning Commission conducted duly noticed public
hearings on October 10, 2no0, November 14, 2000, and November 28, 2000, to consider
testimony both in opposition to, and in favor of, a negative declaration on the proposed
code amendment and forwarded a recommendation of approval to the Planning
Commission and City Council; and
WHEREAS, on February 6, 2001 the City Council held a duly noticed public
haaring to consider testimony both in opposition to, and in favor of, a negative declaration
on the proposed code amendment; and

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby find that:
The project will not result in potentially significant environmental impz^ts.
The project does not affect natural habitat and/or protected animal or plant
species and is exempt from the Department of Fish and Game Code
pursuant to Section 7.11.4(d) of the California Fish and Game Code.
BE IT FURTHER RESOLVED, that the City Council confirms a negative
declaration for adoption of an ordinance to add Section 9-2.319 relating to the regulation
of proposed mobilehome park conversions, closures, and cessation of use.
